Application for notification of affordable housing project as specified business under section 46
Under the Income-tax Rules, 2026, Form No. 18 replaces the erstwhile Form 3CN. It is governed by Section 46 of the Income-tax Act, 2025 (which replaces the old Section 35AD) and Rule 36 of the Income-tax Rules, 2026 (replacing the old Rule 11-OA).

1. Purpose of the Form Form 18 is the prescribed application used to seek the notification of an affordable housing project as a “specified business”. 2. Applicability (Who Should File) The form must be filed by an assessee who is carrying on, or proposes to carry on, an affordable housing project and seeks to have it officially notified as a specified business.
3. Is Filing Mandatory? Yes, filing Form 18 is strictly mandatory for claiming any tax benefits for an affordable housing project under section 46 of the Income-tax Act, 2025.
4. Structure of the Form The form is systematically divided into six main parts to capture all necessary details to evaluate the project and verify its compliance:
- Particulars of the assessee: Captures basic details such as Name, Address, Permanent Account Number (PAN), Status, Residential status, Email address, and Contact number.
- Particulars of the specified business: Captures the name and address of the specified business, the name of the affordable housing project, its complete address, and whether the project is located in a “specified city”.
- Details of the proposed project: Requires disclosures regarding the land area, date of approval, and the building plan approval.
- Fulfilment of prescribed conditions: Requires compliance reporting by providing category-wise details of units and rentable area, confirming that the project meets the specific percentage thresholds prescribed under the rules.
- Other project-related details: Captures the proposed investment amount, expected and actual dates of commencement of the project, whether the project is a separate identifiable area, and the existence of any adjacent or nearby land/project.
- Declaration: Contains the formal declaration and verification by the applicant.
5. Filing Instructions and Validation
- Currency: All monetary amounts in the form must be reported in Indian Rupees (₹) unless specifically directed otherwise.
- Pre-filling: Certain basic details of the assessee may be pre-filled based on the records available with the Income-tax Department, though the applicant remains fully responsible for ensuring the accuracy of all furnished details.
- Signatory: The form must be formally signed and verified by the applicant or an authorised signatory, clearly mentioning their name and designation.
6. Consequences of Incorrect Information Furnishing false or incorrect information in Form 18 carries severe implications, as it can result in the denial or withdrawal of the notification under section 46, and may also attract penal actions under the relevant provisions of the Income-tax Act, 2025.
