How to Fill Form 97 Income Tax for No PAN Step by Step Guide

Form No. 97 is a declaration filed by persons (other than companies or firms) or certain foreign companies who do not have a PAN and enter into specific high-value transactions. This form replaces the older Form 60/61 framework under the Income-tax Act, 2025.

Pre-Requisites for Filing

  • No PAN: You must not have a Permanent Account Number.
  • Income Limit: Your estimated total income for the financial year must be below the maximum amount not chargeable to tax (the basic exemption limit ). Note : Basic Exemption limit is Rs 4 Lakh in New tax regime.
  • Exception: If your income exceeds the limit, you must apply for a PAN first and provide the application acknowledgement details in Part C.

Step 1: Part-A (Nature of Transaction)

Identify the transaction type and enter the corresponding Code from Note 2:

  • 01: Real Estate (Purchase/Sale/Gift/JDA).
  • 02: Opening a Bank Account (other than basic savings).
  • 03: Time Deposits (Fixed Deposits).
  • 04: Insurance account commencement.
  • 05: High-value payments to Hotels/Restaurants/Event Managers.
  • 06: Others (Goods and services not classified above).

Step 2: Part-B (Declaration of Status)

  • Select your status (e.g., Individual, HUF, Trust, or Foreign Company).
  • By signing this part, you declare that your total income (including clubbed income of spouse/minor child) is below the taxable limit.
  • Foreign Companies: Declare if you have no income chargeable to tax in India.

Step 3: Part-C (Personal & Contact Details)

  1. Name (Item 1): Full name without abbreviations (First, Middle, Last). Entities use the name on registration docs.
  2. DOB/DOI (Item 2): Date of birth for individuals; Date of Incorporation for others.
  3. Father’s Name (Item 3): Required for individuals.
  4. PAN Application (Item 4): If you’ve applied for PAN but haven’t received it, enter the Date of Application and Acknowledgement Number.
  5. Aadhaar (Item 5): Enter your 12-digit Aadhaar number.
  6. Address (Items 6-8): Provide full details including Flat/Door, Road, Pin Code, and State.
  7. Contact (Item 9): Mobile number and Email ID are mandatory.
  8. Foreign Entities (Item 10-11): Provide the Taxpayer Identification Number (TIN) from your home country and details of any Indian income.

Step 4: Part-D (Transaction Details)

  1. Date & Amount: Enter the date and total value of the transaction.
  2. Cash Component: Specifically mention how much of the total amount was paid in cash.
  3. Mode (Item 4): Use codes from Note 12 (01 for Cash, 02 for Cheque, 05 for Online, 07 for UPI, etc.).
  4. Joint Transactions: If there are multiple parties, list the total number of persons and your specific % share.

Step 5: Part-E (Documentary Proof)

List the documents you are attaching for:

  1. Proof of Identity (POI)
  2. Proof of Address (POA)
  3. Proof of DoB/DoI Refer to the table in Note 13 for valid codes (e.g., Aadhaar is Code 01, Passport is Code 06).

Step 6: Part-F (Verification)

  • Write your name and your father’s/husband’s name.
  • Specify your capacity (e.g., “Self” or “Representative Assessee”).
  • Sign and date the form.

Common Errors to Avoid

  • Incomplete Address: Ensure all 8 elements (Note 8) are present.
  • Missing Signatures: The form must be signed in both Part B and Part F.
  • Wrong Code: Using the old Form 60 codes instead of the new Form 97 codes.
  • Income Limit: If income is taxable, filing Form 97 without a PAN application acknowledgement is invalid.
