<p data-pm-slice="1 3 []">Form No. 97 is a declaration filed by persons (other than companies or firms) or certain foreign companies who <strong>do not have a PAN</strong> and enter into specific high-value transactions. This form replaces the older Form 60/61 framework under the Income-tax Act, 2025.</p>

<h3><strong>Pre-Requisites for Filing</strong></h3>
<ul>
<li><strong>No PAN:</strong> You must not have a Permanent Account Number.</li>
<li><strong>Income Limit:</strong> Your estimated total income for the financial year must be below the maximum amount not chargeable to tax (the basic exemption limit ). Note : Basic Exemption limit is Rs 4 Lakh in New tax regime.</li>
<li><strong>Exception:</strong> If your income exceeds the limit, you <strong>must</strong> apply for a PAN first and provide the application acknowledgement details in Part C.</li>

<p>Identify the transaction type and enter the corresponding <strong>Code</strong> from Note 2:</p>

<li><strong>01:</strong> Real Estate (Purchase/Sale/Gift/JDA).</li>
<li><strong>02:</strong> Opening a Bank Account (other than basic savings).</li>
<li><strong>03:</strong> Time Deposits (Fixed Deposits).</li>
<li><strong>04:</strong> Insurance account commencement.</li>
<li><strong>05:</strong> High-value payments to Hotels/Restaurants/Event Managers.</li>
<li><strong>06:</strong> Others (Goods and services not classified above).</li>
</ul>
<h3><strong>Step 2: Part-B (Declaration of Status)</strong></h3>
<ul>
<li>Select your status (e.g., Individual, HUF, Trust, or Foreign Company).</li>
<li>By signing this part, you declare that your total income (including clubbed income of spouse/minor child) is below the taxable limit.</li>
<li><strong>Foreign Companies:</strong> Declare if you have no income chargeable to tax in India.</li>
</ul>
<h3><strong>Step 3: Part-C (Personal &amp; Contact Details)</strong></h3>
<ol>
<li><strong>Name (Item 1):</strong> Full name without abbreviations (First, Middle, Last). Entities use the name on registration docs.</li>
<li><strong>DOB/DOI (Item 2):</strong> Date of birth for individuals; Date of Incorporation for others.</li>
<li><strong>Father’s Name (Item 3):</strong> Required for individuals.</li>
<li><strong>PAN Application (Item 4):</strong> If you&#8217;ve applied for PAN but haven&#8217;t received it, enter the <strong>Date of Application</strong> and <strong>Acknowledgement Number</strong>.</li>
<li><strong>Aadhaar (Item 5):</strong> Enter your 12-digit Aadhaar number.</li>
<li><strong>Address (Items 6-8):</strong> Provide full details including Flat/Door, Road, Pin Code, and State.</li>
