Key Points before choosing your company name

The MCA (Ministry of Corporate Affairs) has a regulatory framework set up that you have to consider while naming your company. If your company name does not fall under the set of rules given by MCA, your application might be rejected. 

A company name has incredible power to lend credibility, assure quality and set customer expectations.

• Check Domain :Before choosing a name check whether Domain is available for creating online website .Once your company name is approved, get your domain name registered.
• Avoid Offensive names :The proposed company name should not be offensive to any section or group in the society. Or should not contain any profanity
• Avoid common Words– Do not add common words like New, Modern, Nav, Shri, Sri, Shree, Sree, Om, Jai, Sai, The, etc. to an existing company name. It will get rejected.
• Avoid adding Place :If your company name is different from the name of an existing company only by adding the name of the place, MCA will not approve. For example, ABC Chandigarh Limited will not be allowed if the name ABC Limited already exists.
• Avoid ‘State’ word – Never use the word ‘State’ while naming your company. Only government companies have the authority to use the word ‘State’ in their names.
• Avoid Similar Names  – A company name that is an exact Hindi translation of an English name for an existing company will not be allowed. For example, ABC Heera Producers will not be approved if a company named ABC Diamond Producers already exists.
• Take mandatory regulators approval – If your company name includes words like ‘Insurance’, ‘Bank’, ‘Stock Exchange’, ‘Venture Capital’, ‘Asset Management’, ‘Nidhi’, ‘Mutual fund’, etc., you are required to get formalities mandated by respective regulators such as IRDA, RBI, SEBI, MCA, etc., depending on the word.
• Avoid Abbreviation name : Abbreviated names such as ‘ABC limited’ or ‘123 limited’ cannot be chosen by new companies
• Avoid using words indicative of Constitution :Proposed company names cannot include words indicative of a separate type of business constitution or legal person or any connotation. For example, words like co-operative, sehkari, trust, partnership, proprietor, society, HUF, firm, Inc., GmbH, SA, PTE, Sdn, AG cannot be a part of company name.
• Avoid Patronage : Proposed company name cannot imply association or connection with or patronage of a national hero or any person held in high esteem or important personages who occupied or occupying important positions in Government. Proposed name cannot imply association with Indian or Foreign Government.
• Check Authorized Capital : Proposed company names that include words like international, globe, universal, continental, asiatic, asia, industries, udyog, hindustan, india, bharat, enterprises, products, business and others may require the company to have a minimum authorised capital of Rs.5 lakhs and above.
• Choose name relevant to your business : “The name should display your products and services with a broad view.”
