Cash bills after 08.11.2016 by accepting old Rs 500,1000 notes
Question : whether assessee can raise cash bills after 08.11.2016 by accepting old Rs 500 Bank Note or Rs 1000 Bank notes and deposit entire sale proceeds into current or CC accounts and make RTGS to suppliers of goods.whether dept can say cash accepted after 08.11.2016 is unaccounted money or black money ?
As the Government of India has declared that currency notes of Rs. 500 and Rs. 1,000 denominations will not be valid from midnight of November 8, 2016, citizens will have to surrender the old notes at any branch of a bank or post office to get the new notes.
Thus After November 8, 2016, Rs. 500 (old) Bank note and Rs. 1,000 Bank note are not legal tender. If somebody accepts these notes (Except for purpose mentioned in list below), it is nothing but accepting waste paper as sale consideration. Consequently, in such a situation, these notes cannot be deposited in current account or saving account.
However certain payments were allowed by Indian Govt with Old notes of Rs 500 and Rs 1000 till 11.11.2016. Now the government has extended this date to 24.11.2016 for the purposes mentioned below:-

Govt. had allowed acceptance of old notes till November 24, 2016 for making payment for following purposes:
Governments and the customers shall provide their identity proof. {Words in Bold are inserted by Govt Notifications Dated 11.11.2016 }
(i) for making payments in all pharmacies on production of doctor’s prescription and proof of identity;
(j) for making payments on all toll plazas on the State and National Highways; { omitted by Govt Notifications Dated 11.11.2016 ]
(k) for payments on purchases LPG gas cylinders;
(l) for making payments to catering services on board, during travel by rail;
(m) for making payments for purchasing tickets for travel by suburban and metro rail services;
(n) for making payments for purchase of entry tickets for any monument maintained by the Archeological Survey of India.”.
(o) for making payments towards any fees, charges, taxes or penalties, payable to the Central or State Governments including Municipal and local bodies;
( p) for making payments towards utility charges including water and electricity which shall be restricted to individuals or households for payment of only arrears or current charges and no advance payments shall be allowed {Words in Bold are inserted by Govt Notifications Dated 11.11.2016 }
