Assessing Officer Cannot Enforce Penalty Demand Under Section 275(1)(a) During Pendency Of Quantum Appeal

Issue

  1. Whether the Assessing Officer has jurisdiction to proceed with penalty proceedings and enforce a demand under Section 275(1)(a) while the assessee’s appeal against the underlying quantum assessment order remains pending before the Commissioner of Income Tax (Appeals).
  2. Whether penalty proceedings initiated or carried out in breach of the statutory embargo under Section 275(1)(a) must be kept in abeyance pending the disposal of the main quantum appeal.

Facts

  • The assessee filed an appeal before the Commissioner of Income Tax (Appeals) [CIT(A)] challenging the additions made in the quantum assessment order.
  • While the quantum appeal was actively pending before the CIT(A), the Assessing Officer proceeded to enforce penalty proceedings and issued a demand against the assessee.
  • The assessee challenged the penalty action, invoking the statutory bar of limitation and embargo contained in Section 275(1)(a) of the Income-tax Act, 1961.

Decision

  • Statutory Embargo Under Section 275(1)(a): In view of the clear statutory mandate under Section 275(1)(a), the Assessing Officer cannot proceed to finalize penalty proceedings or issue a enforceable demand while an appeal against the quantum assessment order is pending before the CIT(A).
  • Mandatory Abeyance of Penalty Action: Proceedings initiated or conducted in violation of Section 275(1)(a) are without jurisdiction and must be kept in abeyance until the final disposal of the quantum appeal by the CIT(A).
  • Outcome: The issue was decided in favor of the assessee.

Key Takeaways

  • Precedence of Quantum Appeal: Penalty proceedings are dependent on the quantum assessment; so long as the quantum assessment order is contested before the first appellate authority, penalty proceedings must pause.
  • Jurisdictional Bar Under Section 275(1)(a): Enforcing penalty orders or issuing demands prior to the disposal of a pending quantum appeal directly violates statutory limitation provisions and renders the action legally unsustainable.
  • Procedural Safeguard for Assessees: Tax authorities are legally bound to hold penalty proceedings in abeyance to prevent premature recovery actions until the underlying tax liability is confirmed in appeal.

Jaspal Singh Sethi, Ms. Rashmi Jha and Ayush Jain, Advs. for the Petitioner. Siddhartha Sinha, SSC and Lakshya, Adv. for the Respondent.
ORDER
1. Mr. Jaspal Singh Sethi, learned counsel for the petitioner submitted that though petitioner’s appeal against the assessment order (on quantum) is pending consideration before the Commissioner of Income Tax (Appeals), without waiting for the decision of the appeal, the Assessing Officer (AO) has passed the impugned penalty order and issued a notice of demand dated 29.06.2026, in spite of petitioner’s request for adjourning the penalty proceedings.
2. Learned counsel raises a preliminary objection that the petitioner can prefer an appeal against the penalty order impugned in the writ petition.
3. Having regard to the facts and circumstances of the case and considering that there is a clear embargo under Section 275(1)(a) of the Income Tax Act, 1961, mandating that until the appeal is decided against the quantum demand, the AO shall keep the penalty proceedings in abeyance, we are of the prima-facie view that the penalty proceedings taken up by the AO are in breach of statutory provision and thus, without jurisdiction.
4. Issue notice. Mr. Lakshya, learned counsel for the respondent accepts notice.
5. Mr. Lakshya, associate to Mr. Siddhartha Sinha, learned Senior Standing Counsel prays for and is granted six weeks’ time to file reply.
6. Rejoinder, if any, be filed within six weeks’ thereafter.
7. List this case on 03.02.2027.
8. Till then, recovery proceedings in furtherance of the penalty order dated 29.06.2026 shall remain stayed.
