NOTIFICATION

New Delhi, the 16th September, 2026

G.S.R. 817(E).— In exercise of the powers conferred by sub-section (1) and clause (r) of sub-section (2) of section 113 of the Merchant Shipping Act, 2025 (24 of 2025) and in supersession of the Merchant Shipping (Medicines, Medical Stores and Appliances) Rules, 1994, and Merchant Shipping (Carriage of Medical Officers) Rules, 1961, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely: –

Chapter I – Preliminary

1. Shorttitle and  — (1) These rules may be called the Merchant Shipping (Medicines, Medical Stores, Appliances, and Medical Officers) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. — (1) These rules shall apply to all Indian ships engaged in international voyage and coasting trade of two hundred gross tonnage or more.

(2) The provisions of these rules shall not apply in respect of any ship or class of ships or shall apply subject to such conditions or modifications as may be specified by the Administration.

3. — (1) In these rules, unless the context otherwise requires, —
   • “Act”means the Merchant Shipping Act, 2025 (24 of 2025);
     • “Annexure”means an Annexure appended to these rules;
   • “Administration”means the Director-General of Maritime Administration;
     • “Medical Guide” means the Ship Captain’s Medical Guide published by the International Maritime Organisation and the World Health Organisation and as revised from time to time;
     • “Medical Officer” means a person possessing a degree in Medicine and Surgery from any University recognised under the National Medical Commission Act 2019 (30 of 2019) and enrolled as a medical practitioner on the register of the Medical Commission of any State;
       • “Official Pharmacopoeia” means the Indian Pharmacopoeia, the National Formulary of India, the British Pharmacopoeia Code and the United States Pharmacopoeia;
     • “port health officer” in a port, includes the health officer or any officer appointed by the Ministry of Health and Family Welfare or any officer working on his behalf, to perform the functions of the Port Health Organisation;

(2) Words and expressions used in these rules and not defined but defined in the Act shall have the meanings respectively assigned to them in that Act.

CHAPTER II -Medicines, Medical Stores and Appliances

4. Scale of medicines, medical stores and appliances. — (1) Every ship shall carry medicines, medical stores and appliances as specified in theAnnexure I in accordance with the latest standards issued by the Ministry of Health and the Ministry of AYUSH including the following, namely: –
   • Medicinesin Part I;

(b) Medical stores and appliances in Part II;

• Publicationsin Part III;

(d) Instruments in Part IV;

• Bandages,dressings and allied items in Part V;

• Disinfectantsin Part VI;

(g) List of kits in Part VII; and

(h) List of registers, logs and charts (addition) in Part VIII.

• Wherethe total number of persons on board exceeds forty, one additional set of each item listed in sub-column (b) of column (2) of Annexure I shall be carried for every additional forty persons or part thereof.

 

• Wherea ship is required to carry a Medical Officer, the scale of medicines and appliances referred to in sub-rule (2) shall be carried for ninety-nine persons and the Medical Officer shall determine the additional medicines to be carried, taking into account the duration of the voyage and the area of operation.
• Everycargo ship on the coasting trade of India engaged in voyages exceeding forty-eight hours shall carry the scale of medicines and appliances specified in in column (3) of Annexure I.
  • Every cargo ship on coasting trade voyages of forty-eight hours or less shall carry the scale of medicines and appliances specified in column (4) of Annexure I

• The case containing the medicines and appliances shall remain locked, and the key shall be kept in the custody of the person authorised by the master.

• Themedicines recommended to be dispensed only under the instructions of a qualified medical practitioner through radio medical advice shall be administered strictly in accordance with such instructions.

5. Scaleof medicines for certain ships. — (1) Every cargo ship carrying chemicals wholly or in part, or the residues of chemical cargoes in quantities exceeding those defined in Volume 1 of the IMDG Code, shall, in addition to the medicines and appliances as per Annexure I, carry the medicines specified in Annexure II.
   • Therecommended quantities of medicines specified in the Annexure II shall be used for treating––

(a) inhalation cases of––

• acrew complement of about twenty-four persons in a major emergency (such as an explosion) for up to twenty-four hours;
  • afew persons in a minor emergency until the ship reaches the next port or receives external assistance;
• ingestionor eye-contact cases of one or two persons until landed or cured; and

(c) skin-contact cases (leakage or spillage) of four persons until landed or cured.

• Where the total number of persons on board exceeds twenty-four but does not exceed fifty, the scale of medicines specified in Annexure II shall be increased by a factor of 1.5 and where the number exceeds fifty, the scale shall be increased by a factor of 2.0.

Explanation. – For the purposes of this rule, the expression “IMDG Code” means the International Maritime Dangerous Goods Code as prescribed by the International Maritime Organisation and as revised from time to time.

6. — (1) All medicines, medical stores and appliances shall conform to the specifications laid down in the current edition of the Official Pharmacopoeias applicable in each case.

(2) All tablets and capsules shall, as far as possible, be packed in proper moisture-resistant packaging to avoid deterioration under humid conditions prevalent at sea.

7. — (1) All labelson containers or wrappings shall be rendered moisture-resistant by using an effective label varnish or other suitable means.

(2) Every label shall indicate—

• thegeneric name of the preparation as given in the Official Pharmacopoeia, in English;
  • the prescribed dose (maximum and minimum), strength, batch number, date of manufacture, date of expiry and the name and address of the manufacturer;
• inthe case of articles meant for external use only, a label bearing the words “FOR EXTERNAL USE ”

8. Poisonsand controlled substances. — (1) Every medicine classified as a “poison” or “controlled substance” shall be clearly marked in capital letters, either in red lettering or on a red background.

(2) All such medicines shall be kept under lock and key in a separate cabinet or chest, and the key shall remain in the custody of the officer authorised by the master.

9. Record — (1) The master shall maintain an up-to-date record of all medicines, medical stores and appliances available on board and the stock, records and the Medical Chest Certificate in original shall be made available for inspection by the port health officer at any time.

• The medicines, medical stores and appliances on board, together with the records, shall be inspected at least once every twelve months by the port health officer or Administration, who shall thereafter issue a certificate in the format prescribed in Annexure III.

 

• Where a ship is not likely to return to an Indian port within twelve months of the last inspection, the master shall procure sufficient medicines and certify compliance with the rules and record the details in a separate register:

Provided that if a vessel is engaged continuously in international trade without calling at an Indian port for a period exceeding twelve months, the master shall in addition to certifying compliance and maintaining the requisite register, ensure that medical stores are inspected and certified annually by a competent foreign port health authority or a recognised medical practitioner in accordance with the Medical Guide.

  10. — Where any particular medicine or medical store listed in Annexures I and II is not available, a substancehaving a closely similar pharmacological action, or a preparation complying with the standards of the Official Pharmacopoeia, may be substituted with the prior sanction of the port health officer or Administration.

11. — The master shall be guided in the use of medicines, medical stores and appliances, by the latest edition of the publications listed in Part III of Annexure I.

12. Specialprecautions in endemic or epidemic  — The master of every ship entering an endemic or epidemic area shall carry adequate preventive and curative medicines as advised by the port health officer or Administration.
    13. —The bio-medical waste from ships shall be disposed of as per Annex V of the MARPOL Convention or the guidelines on Bio-medical Waste Management issued by the appropriate authority.
    14. Replacement of medicines. — (1) All medicines consumed during a voyage shall be replaced at the next port of

15. — (1) All medicines shall be stored in proper lockers or medicine chests to prevent displacement at sea.

    16. — (1) Before administering any drug, the individual shall be verbally ascertained for known drug sensitivities and in case any adverse reaction occurs, administration of the medicine shall be stopped immediately.

(2) Where any persons experience adverse effects from the same medicine, the entire batch shall be sealed and reported to the port health officer at the next port, along with samples and details of the reaction and remaining stock shall be used only if permitted by the port health officer.

17. Carriage of additional persons or supernumeraries. — Where supernumeraries are carried on board, the concerned seafarer shall ensure that any special medicines required for such persons (including family members) are procured in consultation with qualified medical practitioner.

18. Specialprecautions regarding infectious  — (1) Where any infectious disease or any event posing public health risk is detected on board, the master shall—
    • takemeasures to provide appropriate treatment to the patient;
      • isolatethe patient;
    • takemeasures to prevent the spread of infection;
      • monitorcontacts for symptoms;
    • ensuresanitary disposal of excreta in cases such as cholera; and

(f) report the case electronically to the port health officer of the next port of call immediately through electronic mail or, where necessary, through VHF communication, port control, or the vessel’s authorised agent.

(2) If a case of human immunodeficiency virus or acquired immunodeficiency syndrome is detected,––

• the patient shall be kept under close surveillance, particularly regarding behaviours involving bodily fluidexposure;

 

• allsyringes and needles shall be discarded as per the guidelines of the National AIDS Control Organisation in the Ministry of Health and Family welfare;
  • personshandling the patient shall use proper personal protective equipment, including gloves, and ensure aseptic disposal of infected materials and body fluids;
• thecase shall be reported to the port health officer at the next port of

19. — (1) The port health officer at any portmay, by written order and subject to such conditions as he may impose and for reasons recorded in writing, exempt any ship from carrying any particular item required under these rules.

(2) The exemption order shall be issued in the form set out in the Annexure IV.

CHAPTER III- Carriage of Medical Officers

20. Carriageof Medical  — Every Indian ship carrying more than one hundred persons, including crew, shall carry on board, as part of its complement, a Medical Officer possessing the qualifications specified in rule 21.

 

 

21. Qualificationsof Medical  — (1) Every Medical Officer referred to in rule 20 shall—
    • possessa degree in medicine and surgery from a recognised University; and

• beduly enrolled as a medical practitioner on the register of the Medical Commission of a State or Union
