GST Registration Cannot Be Retrospectively Cancelled Without Explicit Proposal in Show Cause Notice

Issue

Whether GST registration can be cancelled with retrospective effect when the Show Cause Notice (SCN) issued to the taxpayer contained no proposal or indication for retrospective cancellation.

Facts

  • Registration Status: The petitioner was a registered person under the GST regime.
  • Issuance of SCN: A Show Cause Notice (SCN) was issued to the petitioner alleging failure to file tax returns for a continuous period of six months.
  • Rejection of Application: The petitioner had previously submitted an application for cancellation of registration, which was rejected by the department.
  • Retrospective Cancellation Order: On June 25, 2025, the competent authority passed an order cancelling the petitioner’s GST registration with retrospective effect from October 1, 2024.
  • Lack of Notice: The SCN carried no proposal, indication, or reason for cancelling the registration from a retrospective date.
  • Challenge: The petitioner challenged the order of retrospective cancellation before the High Court.

Decision

  • Absence of Proposal in SCN: In the absence of any specific proposal or indication in the SCN regarding retrospective cancellation, the department cannot order cancellation with retrospective effect [Partly in favour of assessee].
  • Modification of Order: The order cancelling the GST registration retrospectively from October 1, 2024, was set aside [Partly in favour of assessee].
  • Prospective Operation: The cancellation of registration shall continue to operate prospectively from the date of the cancellation order [Partly in favour of assessee].

Key Takeaways

  • Principle of Natural Justice: A Show Cause Notice must explicitly mention the intention and grounds for retrospective cancellation to give the taxpayer an opportunity to respond.
  • Scope of Adjudication: Adjudicating authorities cannot issue cancellation orders with retrospective effect if such a remedy was not proposed in the underlying show cause notice.

1. The Petitioner prays for quashing of the order dated 25.06.2025, whereby his GST Registration No. 07BAGPJ6722B1Z2 was cancelled with effect from 01.10.2024.
2. The Petitioner was served with a Show Cause Notice alleging that he had failed to file returns for a continuous period of six (06) months.
3. The Petitioner had also applied for cancellation of his GST Registration, which application was rejected on 11.03.2025.
