IRDA invites comments on draft of Health Insurance Regulations 2016

IRDA (Health Insurance) Regulations, 2013 were notified on 16th February, 2013 specifying therein various matters concerning the administration of health insurance. Subsequently, first amendment was carried out vide IRDA (Health Insurance) (First Amendment) Regulations, 2014 vide notification dated 19th November, 2014. Since the notification of these Regulations, the Health Insurance Business made progress in terms of spread of the business and product choice. The Health Insurance Business has also been identified as one of the separate classes of the business in the Insurance Laws (Amendment) Act, 2015.

To examine the extant regulatory framework vis-a-vis the Business practices, the Authority constituted an Expert Committee on 29th December, 2014, which has submitted its report on 24th April, 2015. On examining the recommendations of the said committee, as also based on the experience gained in reviewing the regulatory framework concerning both the TPAs and Health Insurance business, it is proposed to revisit the existing Health Insurance Regulations, 2013 by suitably aligning the TPA Regulations as well as revisit some of the provisions of the Health Insurance Regulations.

Accordingly, an exposure draft on IRDAI (Health Insurance) Regulations, 2016 is herewith attached seeking comments. All stakeholders are requested to review the attached exposure draft and forward their views / comments in the prescribed format to the following address before         01stFebruary, 2016.
