NOTIFICATION

New Delhi, the 16th September, 2026

G.S.R. 814(E).—In exercise of the powers conferred by clauses (b), (c), (j), (k),

(l) and (m) of sub-section (2) of section 280 read with sub-sections (1) and (2) of section 264, sub-sections (1) and (2) of section 273 and sub-section (1) of section 275 of the Merchant Shipping Act, 2025 (24 of 2025), and in supersession of the Merchant Shipping (Sailing Vessels) Rules, 1997, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:––

CHAPTER I

Preliminary

 

  1. Short title and commencement. –– (1) These rules may be called the Merchant Shipping (Sailing Vessels) Rules, 2026.

(2) They shall come into force from the date of their publication in the Official Gazette.

 

  1. — Save as otherwise provided, these rules shall apply to every mechanised sailing vessel engaged in sea going trade.

 

  1. ––(1) In these rules, unless the context otherwise requires,––
    • “Act”means the Merchant Shipping Act, 2025 (24 of 2025);
      • “certificate of inspection” means a certificate issued to a sailing vessel in Form SVIC 3 for validity stated therein, subject to annual inspection;
    • “certificateof registry” means the primary certificate issued by the Registrar for ensuring the lawful registration of the vessel at the port of registry;
      • “fair season” and “foul season” mean, respectively, the seasons as specified in Schedule III;
    • “Form”means the Forms set out in Schedule XII appended to these rules;
      • “identity card” means an identity card of a seafarer, which includes the continuous service record of the seafarer;
    • “issuingauthority” means the authority as specified in Schedule IV;
    • “length”means the length described in Schedule II;
  • “mechanisedsailing vessel” means a sailing vessel fitted with mechanical means of propulsion;
    • “Mercantile Marine Department” means the Mercantile Marine Department (MMD) established under section 11 of the Merchant Shipping Act, 2025 (24 of 2025), having jurisdiction over the area in which the concerned vessel is located;

 

 

 

  • “muster list” means a list of the crew who are required to assemble at a given muster station;
  • “musterstation” means the area designated as such on board a vessel for assembly of crew;
    • “notice”means any notice, circular, order or guidelines issued in writing by the Director-General from time to time in relation to sailing vessels;
  • “recognised organisation” means a person or bodyof persons authorised by the Central Government under the proviso to section 9 of the Act;
    • “register book” means the register book of sailing vessels maintained by the Registrar at the port of registry;
  • “registeredtonnage” or “net tonnage” means the tonnage arrived at after allowing permissible deductions from gross tonnage, as specified in vessel’s measurement in Schedule II;
    • “Schedule”means the Schedule appended to these rules;
  • “ton”means a unit of volume equal to 100 cubic feet or 83 cubic metres;
    • “tonnage deck” in the case of decked vessel, means the uppermost continuous deck having permanent means of closing the openings on deck.

(2) The words and expressions used in these rules and not defined herein, but defined in the Act shall have the meanings respectively assigned to them in the Act.

 

CHAPTER II

REGISTRATION AND TONNAGE MEASUREMENT

  1. Registration of sailing vessel.–– Every sailing vessel shall be registered with the Registrar:

Provided that the sailing vessels registered prior to the date of enforcement of these rules shall be deemed to be registered for the purposes of these rules.

  1. Applicationfor registration and –– (1) Every application for the registration of a sailing vessel under sub-section (5) of section 20 read with sub-section (3) of section 15 of the Act shall be made in SVR Form I to the Registrar of the port of registry nearest to the place where the owner resides or where the vessel is built or may be based.
    • Everysuch application shall be accompanied by––
  • adeclaration of ownership by the applicant as specified in SVR Form II or SVR Form III, as the case may be;
    • thedocuments of title to the vessel;
    • thebuilder’s certificate:

Provided that due to certain reasons if it is not possible for the owner to produce the builder’s certificate, keeping in view the circumstances, the Registrar may dispense with the same.

 

  • Thetonnage of the vessel shall be determined in accordance with Schedule

Explanation.—For the purposes of this rule, the expressions––

  • “builder certificate” means a certificate issued by the shipbuilder or shipyard or the recognised organisation specifying the details of the vessel and its year of built,at the time of delivery of a newly constructed vessel, certifying that the vessel has been completely built, fitted and equipped in accordance with the approved plans and specifications;
  • “portof registry” means the port of registry as specified in Schedule
  1. Name of vessel.–– At the time of registration, the owner shall specifythe name of the vessel and the name of the vessel so registered shall not be described by any other name:

Provided that if the name proposed by the owner is already borne by another vessel or if the name be so similar as is calculated or likely to deceive, the Registrar may refuse the registration by such name and require the owner to suggest another name by which the vessel may be registered.

 

  1. Official number of vessel.––(1) The Registrar shall, upon being satisfied with the details of the application under rule 4, assign to the vessel an official number from a consecutive series maintained at each port of registry preceded by three distinguishing code letters indicating the port of registry as specified in Schedule I.

(2) The official number once assigned to a sailing vessel shall not be changed except when the vessel is registered again at another port of registry.

 

  1. Provisionalcertificate of ––(1) Where an application for the registration of a sailing vessel is pending before the Registrar and the Registrar, having regard to the circumstances of the case, is of the opinion that the vessel should not be detained at the port till the issue of the certificate of registry, he may, to avoid such detention, issue a provisional certificate of registry in SVR Form X.
    • A sailing vessel may also be issued a provisional certificate of registry or a tonnage measurement certificate for a specific period to facilitate relocation of vessel for fitment of its equipment, engine, other fittings or delivery voyage.
    • The provisional certificate shall be issued under this rule after obtaining a certificate of inspection of such vessel:

Provided that the validity period of the certificate of inspection shall not exceed the validity period of the provisional certificate:

Provided further that all such certificate of inspection shall be issued only to a vessel not carrying cargo.

  • Every provisional certificate issued under this rule shall specify the particulars of the vessel and of the owner and tindal thereof, or in the case of registration afresh, the particulars as entered in the original certificate of registration.
  • Aprovisional certificate issued under this rule shall be valid for a period not exceeding six months:

Provided that the Registrar may, if he is satisfied that, in the circumstances of the case it is necessary to do so, extend the period of validity by a further period of three months.

  • The provisional certificate issued under this rule shall be surrendered to the Registrar onthe expiry of the period of validity or on issuance of a permanent certificate of registry, whichever is earlier.

 

  1. Grant of certificate of registry.–– (1) On completion of all the requirements for the registration of sailing vessel, the Registrar shall, after the tonnage of the vessel has been determinedin accordance with Schedule II, enter the particulars of the vessel in the register book as per SVR Form IV and grant a certificate of registry.
    • Everycertificate of registry granted under sub-rule (1) shall be issued in SVR Form
    • Thecertificate of registry shall be produced by the owner or tindal of the sailing vessel on demand by a Registrar or any officer of the Customs or of the Mercantile Marine Department or a Regional Officer (Sails).

 

  1. Painting of name and official number on vessel.–– (1) The code letters indicating theport of registry, the name of the vessel by which it is registered and the official number assigned to it shall be painted in white oil colour against a black background on both quarters of the vessel near the stern.
  • All letters and figures painted shall be of such size as the Registrar may determine in eachcase, but shall not be less than one decimetre in height and two centimetres in
  • The letters and figures referred to in this rule shall also be painted in suitable size on the dinghies attached to the vessel.
    • Thename and official number of the vessel shall also be painted or permanently marked on all life boats or rescue boats or life rafts carried by the vessel.

 

  1. Change of name.–– (1) The name of the vessel under which it has been registered shall not, after such registration, be altered or changed except with the prior approval of the Registrar.
  • Everyapplication for the change of name of the vessel shall be made to the Registrar of the vessel’s port of registry specifying the reasons for the proposed change and the

Registrar may, if satisfied that the change proposed is reasonable and necessary, approve the change.

  • Wherethe name of the vessel which is mortgaged is sought to be changed, the consent of the mortgagee shall also be obtained for the proposed change.
  • Thenew name which has been approved by the Registrar shall be entered in the register book and in the certificate of registry of the vessel.

 

  1. Registrationof –– (1) An application for the registration of alterations to a vessel shall be made in SVR Form VI—
  • within a period of fifteen days of such alteration to the Registrar of the port where the vessel is registered; and
  • to any port having a Registrar or if it is made elsewhere, the Registrar of the first port at which the vessel arrives after the alteration, or in case the vessel so altered is outside Indian port, the Registrar may, on a report of inspection of such vesselby a surveyor or the person authorised under section 9 of the Act, re-register the vessel without any requirement of the vessel to visit Indian port.

(2) Where the alterations—

  • do not materially affect the dimensions or the tonnage of the vessel or its carryingcapacity, the Registrar shall enter the alterations in the register book and also in the certificate of registry of the vessel;
  • materiallyaffect the dimensions or the tonnage or the carrying capacity of the vessel, the Registrar shall register the vessel afresh within a period of thirty days on receipt of application or completion of alteration, whichever is later.

 

  1. Declaration of ownership.–– Every declaration of ownership shall be made before the Registrar, Special Executive Magistrate, a Commissioner of Oaths or an Indian Ambassador and where a declaration of ownership is made at a place other than the port of registry, the place of attestation shall be stated in the declaration.

 

 

  1. Transfer of port of registry.–– (1) Any person having an interest in the vessel, whether as owner or mortgagee, who desires that the registry of the vessel may be transferred from one port to another, shall make an application for transfer in SVR Form VII to the Registrar of the port of registry for such transfer.
  • The Registrar shall, if he is satisfied that the proposed transfer is unobjectionable, transmitthe particulars of the vessel and the encumbrances, if any thereon, to the Registrar of the intended port of registry.
  • TheRegistrar at the intended port of registry, after he is satisfied that the new official number with the code letters of the port are duly painted on the vessel, shall issue a fresh

 

certificate of registry and communicate to the Registrar of the original port of registry the official number assigned to the vessel and the date of its registry.

 

  1. Closure of registry.–– (1) Where the registration of the vessel is transferred under rule14, the Registrar of the original port of registry shall close the registration of the vessel in the register book.

(2) Where the registration of the vessel at any port is closed under section 43 of the Act, or under sub-rule (1), the Registrar of the port shall forthwith submit to the Director-General a statement of the particulars of the vessel and the circumstances in which the registration has been closed.

 

  1. Transfer of vessel or interest therein.–– (1) The owner or the owners of the vessel desiringto transfer the vessel or any interest therein shall apply to the Registrar of the port of registry for permission to do so.
  • The Registrar, after making such enquiry as he thinks fit, shall grant permission for transfer of ownership within a period of fifteen days from the date of receipt of such
    • After the transfer of ownership is permitted and the sale has been effected, the transfereeshall present to the Registrar of the port of registry, a declaration of ownership, the instrument of transfer and the existing certificate of registry of the vessel, and thereupon, the Registrar shall enter the particulars of the transfer of ownership in his register book and issue a fresh certificate of registry.
  • The Registrar shall, on transfer of ownership and issuance of a fresh certificate of registry, intimate the same to the Director-General.

 

  1. Transfer of ownership by operation of law.–– (1) Where the title to the vessel devolveson any person by operation of law under section 24 of the Act, such person shall apply to the Registrar specifying the circumstances in which he has acquired title to the vessel and also adducing evidence of such acquisition.

(2) If the Registrar, after making such enquiry is satisfied about the claim of the applicant, he shall register the particulars of change of ownership in his register book and also endorse the particulars in the certificate of registry of the vessel.

 

  1. Mortgage of vessel.–– (1) Every instrument of mortgage of a vessel or any interest therein shall be as specified in SVR Form VIII or SVR Form IX, as the case may be.
  • The Registrar shall, after satisfying himself that the instrument is properly executed, record the same in his register book with the date and hour of acceptance and make an endorsement to that effect on the mortgage instrument.

 

  • Wherethere are two or more mortgages on the same vessel, their respective priorities shall be indicated in the register book in the appropriate column in alphabetical order.
  • Whenthe mortgage debt is fully discharged, the Registrar shall, after satisfying himself that the receipt endorsed on the mortgage instrument is in order and that it is properly witnessed, make an entry in the register book relating to the discharge of the mortgage.
    • No payment of ownership of any instalment of a mortgage debt shall be recorded in the register.

 

  1. Issue of duplicate copies of certificate of registry.–– (1) The Registrar, on an applicationmade by the owner to issue a duplicate copy of the certificate of registry may, after satisfying himself to the effect that the original certificate has been destroyed, lost, mislaid, mutilated or defaced, issue the same clearly marked on it “DUPLICATE” in red
  • Every application for duplicate copy of a certificate of registry shall be accompanied bya declaration of the circumstances in which the original certificate was destroyed, lost, mislaid, mutilated or defaced.
  • Wherea duplicate copy of a certificate of registry has been obtained on the ground that the original certificate has been lost or mislaid, and such certificate is subsequently found or received by the owner, he shall forthwith surrender the original certificate to the Registrar who shall cancel the same.
    • A duplicate copy of the certificate of registry shall not be granted on the ground that the original has been mutilated or defaced unless the mutilated or defaced certificate is surrendered to the Registrar.

 

  1. Central register.–– (1) The Director-General shall maintain a central register or online portal which shall contain all the entries recorded in the register book.
  • Oncompletion of the registration of a vessel at a port, the Registrar shall immediately transmit to the Director-General a copy of the entries in his register book relating to the
    • The particulars of every other transaction subsequently recorded in the register book shall also be reported forthwith to the Director-General.

 

  1. Inspectionof register book and supply of copies of –– (1) The register book maintained by the Registrar, shall on application made in this behalf and on payment of the fees in accordance with Schedule V, be open to inspection by any person during office hours.

 

(2) A certified copy of any entry in a register book may be granted by the Registrar to any person on an application made in that behalf and on payment of fee as specified in Schedule V.

 

CHAPTER III

Freeboard and Certificate of Inspection

 

 

  1. Assignment of freeboard.–– (1) No vessel shall ply or proceed to sea unless it has been assigned freeboard in accordance with the provisions of these rules.
  • TheRegistrar shall ensure that the vessel’s name and registration number is cut at least three millimetre deep, in wood of hull at bow and stern and shall be painted white or yellow on a dark background.
  • Thefreeboards for vessels shall be computed in accordance with Schedule

 

23. Application for certificate of inspection or survey for assignment of freeboard.––

(1) Every application for grant of certificate of inspection shall be made in Form SVIC-1 to the jurisdictional MMD or a recognised organisation and accompanied by such fee as specified in Schedule V.

  • TheRegistrar shall cause the sailing vessel to be––
  • inspectedby the surveyor;
    • surveyedby the surveyor for assignment of freeboard,

who shall, on completion of the inspection or survey, forward to the Registrar, the report on the result of such inspection or survey for assignment of freeboard.

  • If upon consideration of the report of the surveyor, the Registrar is satisfied that the freeboardmay be assigned, he shall furnish to the owner the particulars of the position in which the deck line and the freeboard line are to be marked.
  • EveryRegistrar shall submit to the Principal Officer of the MMD of the District on or before 15th January and 15th July of each year, a return showing the particulars of certificates of inspection issued during the previous half-year in the Form SVIC-4.

 

  1. Preparationfor –– (1) The vessel shall be made clean and free from cargo.
  • Riggingand equipment shall be kept handy for
    • The vessel shall becleaned externally and placed on a hard or slipway sufficiently clear of the ground:

Provided that unless the surveyor has any reason to doubt the condition of the hull, such activity shall be carried out only once in three years.

 

  1. ––(1) The owner of the vessel shall cause to be marked on each side of the vessel, the particulars of the deck and the freeboard lines and also the disk as per the following figure:

(2) The markings referred to in sub-rule (1) shall be cut into the planking to a depth of at least three millimetres and shall be painted white or yellow on a dark background.

 

  1. ––(1) The hull shall be inspected to determine whether the vessel is staunch and tight and strong enough for the service intended.
  • Thejoints in planking and caulking shall be carefully
    • In the case of decked vessels, it shall be ensured that the deck planking is in good condition and properly caulked and that efficient means of battening down the hatches is
  • Itshall be ensured that––
  • thesails are of strong and durable material and in good condition and of sufficient area to enable efficient navigation under sails alone;
  • allblocks, pulleys and ropes are in good condition and of sufficient strength;
  • theanchors, chains, hawsers are sufficient and
    • Specialattention shall be paid to the condition of the rudder and helm and their
  • Allpumps shall be tested for efficiency by actually working them for not less than ten
    • It shall be ensured that the freeboard markings are properly marked and maintained and that no alterations affecting the position of the freeboard markings have taken place.
  • Theengine compartment shall be partitioned off from the cargo space using bulkheads and it shall be insulated with non-combustible panelling and covered with GI sheets.
  • Theexhaust uptake shall be properly

 

  • Theengine, auxiliary machineries and stern glands shall be in good
  1. –– (1)Every vessel shall be equipped with lifesaving and fire appliances specified under Chapter IV of these rules:

Provided that a sailing vessel constructed or re-built on or before the 1st day of January 2027, shall comply with these rules to such extent as may be determined by the Director-General:

Provided further that, the Director-General may permit such exemption, modification, or equivalent arrangement as it considers appropriate, in respect of any such vessel.

  • In addition to statutory lifesaving appliances, firefighting appliances, distress, safety and radio communication requirements, Indian mechanised sailing vessels shall comply with the safety and security communication, navigation and reporting measures and standard operating procedures, as may be specified by the Central Government or the Director-General from time to time.
  • Everyvessel of over 100 gross tons shall be provided with at least one hand operated pump for pumping bilges only.
  • Forvessels of 200 gross tons and above, an electrical or mechanical driven pump shall replace hand operated pump and one such pump for each 300 gross tonnage, in multiples thereof, shall be provided.
  • Pumpingand piping arrangement shall be such that the pump is able to take suction to make the bilge dry and generate sufficient pressure to throw water at least two metres above the ship’s main gunwale from bottom of the vessel.
    • In vessels of 400 gross tonnage and above, at least one such pump shall be of fixed type and have arrangement to pump out oilybilge water from bilge holding tank to shore reception facility.
  • Everyvessel other than the coasting vessel––
  • shall be provided with a fixed compass having steady card and one spare portable compass for use in emergency or in lifeboat;
    • of less than 200 tons, shall be provided with a VHF set and an AIS, in compliance of notices issued from time to time.
      • The lights, shapes and sound signals shall be provided in accordance with the applicable rules under the Act.

(9) Every vessel shall be provided with the following communication equipment, namely:––

  • VHFat the option of owners for sailing vessels above 200 gross tonnage;
  • ShipSecurity Alert System (SSAS) or DAT;

 

 

 

  • AISClass-A (Automatic Identification System);
  • EPIRBor DAT;
  • NAVTEXreceiver or Satellite Phone; and

(f) MF/HF or Satellite Phone.

 

  1. Pollution prevention and environmental control requirements.–– (1) No vessel shall use heavy or persistent oil as fuel in any machinery.
    • High-speeddiesel or lighter non persistent fuels are only permitted on
    • Everyvessel of 400 gross tonnage shall be provided with a bilge holding tank made of steel or similar material in compliance of notices issued from time to time.
    • Everyvessel of 400 gross tonnage or above with—
  • eighteenor more crew members, shall be provided with a biodegradable system toilet;
    • nineteen or more and up to twenty-two crew members, shall be provided with pro-rata additional capacity of holding tank with only one toilet;
  • twenty-threecrew members and above, shall be provided with additional toilets on the basis of one per eighteen persons.
    • Thesewage holding tank and biodegradable toilet shall be as per design and type approved by any Central Government or State Government accredited body.
  • Themarine diesel engine installed on a vessel shall comply with the following Nitrogen Oxide (NOx) emission limits: —
  • 4 g/kWh, whenn is less than 130 rpm;
  • 9·n^(-0.2) g/kWh,when n is 130 or more, but less than 2000 rpm;
  • 0 g/kWh,when n is 2000 rpm or more,

where n is rated engine speed (crankshaft revolutions per minute).

 

  1. Auxiliary engines.–– (1)Before a vessel is fitted with an auxiliary engine, it shall be inspected by a surveyor to ascertain whether the hull is of adequate strength for the engines to be installed.

(2) The engine shall be fitted and necessary tests and speed trials carried out to the satisfaction of a surveyor:

Provided that unless the surveyor has any reason to doubt the efficiency of an engine, complete dismantling and inspection shall be carried out only once in five years.

  1. Fueloil storage and bilge holding –– (1) The fuel oil storage and service tanks shall be properly constructed, mounted self-supporting, provided with proper filling arrangement, air vent and gauging ability.

 

  • The fuel supply from the tank shall be fitted with a metallic fuel cock with remotely closing mechanism.
  • Everyvessel less than or equal to 500 gross tonnage (GT) shall be fitted with 500 litres capacity of bilge water holding tank, and for every 100 tonnes increase in GT of such vessel, there shall be an increase of 100 litres in bilge water holding capacity:

Provided that the capacity of the bilge water holding tank shall not be more than one cubic metre plus one change of lube oil from all engines or machinery, likely to have such change when vessel is at sea.

  1. –– Ifa surveyor finds that any defect exists in the hull, rigging, equipment or machinery of a vessel, he shall inform the owner or tindal of the vessel in Form SVIC 2 pointing out the defects and necessary repairs and the owner or tindal shall ensure that the repairs are carried out to the satisfaction of the surveyor.
  1. Issueof certificate of –– (1) On being satisfied that the vessel has complied with the provisions of these rules, the Principal Officer of the MMD shall issue a certificate of inspection in Form SVIC 3.

(2) Every certificate of inspection issued under sub-rule (1) shall be valid from the date of its issue for a period of three years, subject to annual inspection of the vessel:

Provided that the surveyor may, for reasons to be recorded in writing, issue a certificate of inspection for such shorter period to the effect of cargo carrying capacity or plying area, as may be specified therein.

 

  1. Expiry or rendering invalid of certificate of inspection.–– (1) Any certificate of inspectionwhich has expired or has become invalid due to structural damage to the vessel or due to deficient equipment or any other cause, shall be surrendered to the MMD in India or Registrar of the vessel, upon reaching the first port of call after such expiry.
  • Ifa vessel is calling a foreign port and such situation arises, the vessel shall inform the port State control officer of the port, and the owner shall inform the Registrar of the vessel
  • Wherea sailing vessel is engaged on a voyage outside India at the time of expiry of its certificate, such certificate shall remain valid until the vessel’s first arrival at a port in India after expiry:

Provided that the vessel proceeds directly thereto without undue delay and no condition affecting the safety of the vessel has arisen.

  1. Alterations to vessel.–– Whenever alterations have taken place in the hull or superstructureof a vessel so as to affect the position of the freeboard lines, the owner shall apply for a fresh freeboard certificate.
    1. Loading of vessel.–– No vessel shall be so loaded that the marking of the freeboard line is submerged.

 

 

 

  1. Issue of duplicate certificate of inspection.–– (1) If any original certificate of inspection is destroyed, lost, mislaid, mutilated or defaced, the Principal Officer of the MMD may, on an application being made to him stating the full facts and upon being satisfied of the genuineness of the case, issue a duplicate certificate of inspection.
  • Everysuch application shall be accompanied by a fee specified in Schedule
  • Ifan original certificate of inspection which is mislaid, lost or destroyed is found after issuance of a duplicate copy thereof, it shall forthwith be surrendered to the Principal Officer of the MMD.
  1. Transfer of registry (certificate endorsement).–– Where a vessel’s registry is transferred or there has been a change of name of ownership or tonnage thereof, the certificate of inspection shall be produced to the Registrar for endorsing the alteration.
    1. Trading–– The trading limits, if any, and the conditions for such trading, shall be specified in the certificate of inspection depending upon the size, type, construction and general suitability of the vessel as may be determined by the surveyor to be fit and in compliance of the notices issued from time to time.

 

 

  1. Production of certificate of inspection.–– The owner or tindal of the vessel shall produce the certificate of inspection on demand by a surveyor or any officer of the Customs or of the Mercantile Marine Department or a Regional Officer (Sails) in India and any Port State Control officer of the country outside India.

CHAPTER IV

Life Saving Appliances and Fire Safety Appliances

 

  1. Firefighting appliances on vessels of 500 gross tonnage and above.–– (1) Every vessel of 500 gross tonnage and above shall be provided with––
  • fire pumps, water service pipes, hydrants hoses and nozzles whereby at least one jet of water can reach any part of the vessel normally accessible to the crew while the vessel is being navigated and any storeroom and any part of any cargo space when empty;
  • at least one fire pump operated by power in accordance with rule 43, capable of delivering at least one jet of water from any fire hydrant hose and nozzle provided in the vessel;
  • a fire main, water service pipes and hydrants and at least three fire hoses and nozzles;

 

 

 

  • atleast the minimum number of portable fire extinguishers and fire buckets, as specified in Schedule VII, suitably distributed and so located as to be readily accessible for immediate use in accommodation spaces, service spaces and machinery spaces;
    • a receptacle containing at least 0.3 cubic metre of sand or other dry material suitable for extinguishing oil fires together with a scoop for its distribution or an additional portable fire extinguisher suitable for extinguishing oil fires in each firing space;
  • an internal combustion propelling machinery fitted in machinery spaces and with–
    • portable fire extinguishers capable of discharging from or other substancessuitable for quenching oil fires, as specified in Schedule VII; or
  • two portable fire extinguishers suitable for extinguishing oil fires together with one foam fire extinguisher of at least forty-five litres or one carbon dioxide fire extinguisher of at least sixteen kilograms capacity.

41. Firefighting appliances on vessels of 150 tons and above but less than 500 tons.–

  • Everyvessel of 150 tons and above, but less than 500 tons shall be provided with––
  • at least one fire pump and fire hose and nozzle whereby a jet of water can be directed into any part of the vessel;
    • a portable diesel driven pump or a hand pump with a hose and nozzle capable of delivering a jet of water having a throw of not less than six metres outside the space, where the pump provided in accordance with clause (a) is situated inside spaces containing internal combustion machinery;
  • atleast the minimum number of portable fire extinguishers and fire buckets, as specified in Schedule VII, suitably distributed and so located as to be readily accessible for immediate use in accommodation spaces, service spaces and machinery spaces.
    • Everysuch vessel fitted with main or auxiliary oil-fired boilers or internal combustion propelling machinery shall be provided with––
      • anozzle suitable for spraying water on oil;
        • a receptacle containing 0.3 cubic metre of sand or other dry material suitable for quenching oil fires together with a scoop for distributing the contents of the receptacle.
      • Ineach space containing any part of any oil fuel installation of such vessel, there shall be provided at least two portable fire extinguishers suitable for extinguishing oil fires.

 

 

 

  • In each machinery space in such vessel, one foam extinguisher of at least forty-five litres capacity or an equivalent carbon dioxide extinguisher shall be provided.
  • Atleast two portable extinguishers capable of discharging foam or any other substance suitable for quenching oil fires shall be provided in such vessel.

42. Fire-fighting appliances on vessels of 50 tons and above but less than 150 tons.–

  • Everyvessel of 50 tons and above, but less than 150 tons shall be provided with––
  • afire pump operated by power and fire hose and nozzle capable of discharging a jet of water into any part of the vessel;
    • a hose and nozzle capable of directing a jet of water having a throw not less than six metres, where the fire pump is driven by main engine outside the machinery space with its sea connection;
  • witha nozzle for spraying water suitable for quenching oil fire;
    • at least the minimum number of portable fire extinguishers and fire buckets, as specified in Schedule VII, suitably distributed and so located as to be readily accessible for immediate use in accommodation spaces, service spaces and machinery spaces.
      • Every such vessel fitted with internal combustion propelling machinery shall be provided with––
    • a receptacle containing 0.3 cubic metre of sand or other dry material suitable for quenching oil fires together with a scoop for distributing the contents of the receptacle;
      • at least two portable fire extinguishers capable of discharging foam or other substances suitable for quenching oil fires.
  1. Fire pumps.–– (1) Except as otherwise provided in these rules, every fire pump required to be carried in a vessel shall be operated by means of power, other than the vessel’s main engines.
    • Thesanitary, bilge or general service pumps may be accepted by the Director-General as fire pumps, provided they are not normally used for pumping oil and in case they are occasionally used for pumping or transferring fuel oil, suitable change-over arrangements may be fitted alongwith operating instructions.
      • Every vessel, which is required to be provided with fire pumps operated by power underthese rules, other than any emergency fire pump, shall together, for the purposes of firefighting, be capable of delivering a quantity of water under the conditions and at the pressure specified in sub-rule (9) which shall not be less than the quantity obtained from the following formula, namely:––

 

Quantity of water is cubic metres per hour = Cd2 where––

  • C=5 for vessels required to be provided with more than one fire pump excludingany emergency fire pump and C=2.5 for vessels required to be provided with only one fire pump; and
  • d=1+0.066√ L(B+D) to the nearest 25 where––

L=length of the vessel in metres on the summer load water line from the foreside of the stem to the aft side of the rudder post and where there is no rudder post, the length is measured from the foreside of the stem to the axis of the rudder stock if that be the greater;

B= greatest moulded breadth of the vessel in metres; and

D= moulded depth of the vessel in metres measured to the bulkhead deck amidships:

Provided that in any such vessel other than those included in the total capacity of the fire pumps for firefighting shall not be required to exceed 180 cubic metres per hour.

  • Inevery vessel which is required to be provided with more than one fire pump operated by power, other than any emergency fire pump, shall have a capacity of not less than eighty per cent. of the total capacity of the fire pumps required by these rules divided by the minimum number of fire pumps so required, but in any case, not less than 25 cubic metres per hour.
    • Every fire pump which is operated by power, other than any emergency fire pump, shall becapable of producing, from any fire hydrant or hydrants in the vessel, at least the minimum number of jets of water required by these rules as appropriate to the class and tonnage of the vessel, while maintaining the pressure required by sub-rule (9).
    • In any vessel in which automatic and remote-control systems have been provided in the machinery space in lieu of continuous manning of the space, arrangements shall be made to ensure immediate availability of water supply at the required pressure either by permanent pressurisation or by suitably placed remote starting of the fire pump.
  • Reliefvalves shall be provided in conjunction with all the fire pumps if the pumps are capable of developing a pressure exceeding the design pressure of fire main, water service pipes, hydrants or hoses:

Provided that such valves shall be so placed and adjusted as to prevent excessive pressure in any part of the fire main system.

  • Everycentrifugal pump which is connected to the fire main shall be fitted with a non-return valve.

 

  • When the two pumps simultaneously deliver water through the nozzles of sizes specified in rule 45 through any adjacent hydrants, a minimum pressure of 2.1 bar (0.2M/mm2) at all hydrants shall be maintained.
  1. Firemain, water service pipes and –– (1) All water pipes and fire hydrants required to be provided under these rules shall be so placed that the fire hoses may easily be coupled to them.
  • In every vessel which is required to be provided with fire pumps operated by power, thediameter of the fire main and of the water service pipes connecting the hydrants thereto shall be sufficient for the effective distribution of the maximum discharge required by these rules from––
  • whereonly one pump is required, that pump; or
  • wheretwo such pumps are required, both pumps operating simultaneously; or
  • where more than two such pumps are required, the two largest of such pumps operate simultaneously.
    • The diameter of the fire main and water service pipes shall be sufficient for the effective distribution of the maximum required discharge from two fire pumps operating simultaneously, except that in the case of cargo vessels, the diameter shall only be sufficient for the discharge of 140 m³ /h.
  • In vessels carryingdeck cargo, the position of the hydrants shall be such that they are always readily accessible with pipes and arranged in a manner to avoid risk of damage from such cargo and in vessels where the deck pipe lines run on exposed deck, two such lines shall be provided.
  • Thewater pipes shall not be––
  • madeof material which may be readily rendered ineffective by heat; and
  • madeof cast iron and if made of cast iron or steel, shall be galvanised or the pipe wall thickness shall be increased by a corrosion allowance.
    • Isolating valves to separate the section of the fire main within the machinery space containingthe main fire pump or pumps from the rest of the fire main shall be fitted in an easily accessible and tenable position outside the machinery spaces.
    • The fire main shall be so arranged that when the isolating valves are shut, all the hydrantson the vessel may be supplied with water by another fire pump or an emergency fire pump except those in the machinery space referred to in sub-rule (6).
  • The emergency fire pump, its seawater inlet and suction, delivery pipes and isolating valvesshall be located outside the machinery space and if this arrangement cannot be

made, the sea-chest may be fitted in the machinery space if the valve is remotely controlled from a position in the same compartment as the emergency fire pump, and the suction pipe is as short as practicable.

  • Short lengths of suction or discharge piping may penetrate the machinery space, provided they are enclosed in a substantial steel casing, or are insulated to A-60 class standardsand the pipes shall have substantial wall thickness, but in no case less than eleven
  • The hydrants valve of screw lift type or cocks shall be fitted to water service pipes and be so arranged that any fire hose coupled to these maybe removed while fire pumps are in operation.
  • All water pipes for fire extinguishing system shall be provided with drain valves or cocks for use in frosty weather and so located that they may not be damaged by cargo.
    1. Fire––(1) The fire hoses shall––
  • beof non-perishable material approved by the Director-General;
    • be sufficient in length to project a jet of water to any of the spaces in which they may be required to be used; and
  • beprovided with a nozzle and the necessary couplings;
  • have alength of at least ten metres, but not more than––
  • fifteenmetres in machinery spaces;
    • twentymetres in other spaces and open decks; and
  • twenty-fivemetres for open decks on vessels with a maximum breadth in excess of thirty metres.
    • Everysuch fire hose together with the tools and fittings shall be kept in a conspicuous position near the hydrants or connection with which it is intended to be used.
    • Thefire hose provided in compliance with these rules shall not be used for any purpose other than for extinguishing fire or testing with fire appliances at fire drill and surveys.
      1. –– (1) Every vessel which is required under these rules to be provided with firepumps operated by power shall be provided with nozzle of twelve millimetres, sixteen millimetres, nineteen millimetres in diameter or as near thereto in diameter as possible and the nozzles larger in diameter may be provided if the requirements of these rules relating to the provision of water for firefighting purposes are otherwise complied with.

 

  • For machinery spaces and exterior location, the diameter of the nozzles shall be such as to obtain the maximum possible discharge from the minimum number of jets of water and at the pressure required under these rules from the smallest fire pump permitted:

Provided that the diameter of the nozzles shall not be greater than nineteen millimetres.

  • Foraccommodation and service space, the diameter of the nozzles shall not be greater than twelve millimetres.
  • Every such nozzle shall be capable of producing a water spray suitable for extinguishing oil fires and a plain water jet and shall incorporate a shut-off facility.
    1. Life-saving—(1) No life saving appliance or arrangement shall be carried on board any vessel unless such appliance or arrangement is of a type approved by the Director-General or a recognised organisation authorised by the Director-General.
      • The Nautical Advisor may recognise approvals granted by the Administration of another country, where such approvals are based on standards equivalent to those prescribed under these rules and the Life-Saving Appliance (LSA) Code.

 

  • Before granting approval, the Nautical Advisor shall ensure that such tests or trials necessaryto confirm compliance with these rules and the Code are carried out:

 

Provided that the Nautical Advisor may, subject to such supervision and conditions as may be specified, authorise a recognised organisation or an approved testing establishment to carry out such tests or trials.

 

  • Every Indian sailing vessel shall be equipped with lifesaving appliances as per Schedule VIII.

 

Explanation.—For the purposes of this rule, the expression “International Life-Saving Appliance (LSA) Code means the International Life Saving Appliance (LSA) Code adopted by the Maritime Safety Committee of the International Maritime Organization resolution MSC.48(66), as amended, from time to time.

CHAPTER V

Crew and Identity Cards

 

  1. Possession of permits or identity cards.–– (1) No person shall serve or be allowed to serve on sailing vessel on any voyage outside India as ––
  • tindal,unless he is in possession of a permit;
  • anyother member of the crew, unless he is in possession of a valid identity card issued under these rules.
    • Theholder of a permit or an identity card shall, on demand by any issuing authority or a Registrar of a vessel or any officer of Customs, produce such permit or identity card for inspection by such authority, Registrar or officer in India and any Port State Control officer of the country outside India.
      • No officer of Customs shall clear outward any vessel, unless the tindal thereof is in possessionof a permit and the other members of the crew thereof are in possession of valid identity cards issued under these rules and a valid Indian passport.
        1. Procedurefor issue of permits or identity cards .–– (1) The Director-General shall maintain a centralised online system for the issue of permit or identity cards to the crew of sailing vessels.
      • Every application for a permit or identity card shall be made electronically specified inForm through the online portal, A, accompanied by the documents and fee as specified under these rules.
        • The Regional Officer (Sails) shall examine the applications in accordance with the provisions of these rules and, upon being satisfied, forward the approved cases to the Director-General for final approval and printing.
      • Thepermit or identity card shall be issued under the authority of the Director-General and shall bear the signature of the Regional Officer (Sails), as the authorised signatory.

50. Documents required and conditions for issuance of permits or identity cards.––

  • Forthe purpose of application of permit or Identity card, the applicant shall possess–
    • avalid passport;
    • avalid address proof;
    • Policeverification;
    • Signatureand
  • Thepermit or identity card shall be issued only to such applicants who serve on Indian sailing vessels plying between Indian ports or Indian ports and any other ports outside
    • The applicant shall produce a letter from the owner or tindal of a sailing vessel to the effect that the applicant will be employed on board the sailing vessel owned by such persons and that the sailing vessel is plying between Indian or foreign ports.

 

  • Theapplicant applying for tindal permit shall have a minimum of three years sea going experience on Indian sailing vessel.
  • Onreceipt of an application, the issuing authority shall, after conducting such inquiry, as he may consider necessary and upon satisfaction, issue an identity card.
    • If an applicant is not issued with identity card or tindal permit then the reason for so declining shall be recorded in writing and a copy given to the applicant.
  • Anyperson whose application has been declined may make a fresh application after a minimum period of one month from the date of the decline.
    • The permitsand identity cards shall be issued in Form B which shall be numbered serially, preceded by the code letters of the port of issue as specified in Schedule I.
  • A permit or an identity card shall be valid for a period of five years from the date of its issue or till the expiry of the passport, whichever is later:

Provided that the issuing authority may for reasons to be recorded in writing, issue a permit or an identity card for a period of less than one year:

Provided further that where, at the expiry of a permit or an identity card, the holder thereof is on a vessel which is on a voyage outside India, such permit or identity card shall be deemed to be valid until such vessel arrives at any port in India.

  • Where a permit or an identitycard is refused by the issuing authority or where such permit or identity card is issued for a period of less than one year, the issuing authority shall inform the applicant in writing stating the reasons thereof, and in the case of refusal, the fee paid shall be refunded to the applicant.
  • Theissuing authority shall forward a duplicate copy of every application received by him under this rule to the Director-General for record and where an application for a permit or an identity card is refused, he shall also send a report stating briefly therein the reasons for such refusal.
    1. Renewalof permit or identity –– (1) The holder of a permit or an identity card shall apply for renewal to the issuing authority within a period of nine months from the expiry of such permit or identity card along with renewal fee specified in Schedule V.
  • The issuing authority shall renew the permit or the identity card for a period of less than one year by making suitable endorsement thereon.
  • Where the issuing authority refuses to renew a permit or an identity card under this ruleor where he renews such permit or identity card for a period of less than one year, he shall inform the holder in writing stating the reasons thereof and in the case of refusal, shall refund the fee to the applicant.
  • Where the issuing authority refuses to renew a permit or an identity card under this rule,he shall send a report to the Principal Officer of the MMD stating briefly therein the reasons for such refusal.
  • The applications for new, renewal, replacement or duplicate permits or identitycards shall be submitted online with required scanned documents and on payment of such fee as specified in Schedule V.
  • TheRegional Officer (Sails) shall review the applications, conduct necessary inquiries, and forward them online to the Director-General for approval.
    • On approval by the Director-General under sub-rule (6), the permits or identitycards shall be printed, signed, laminated and dispatched to the applicant by speed post.
  1. Suspension and cancellation of permit or identity card and maintenance of records and registers thereof.–– (1) If the issuing authority has reasons to believe that the holder of a permit or an identity card has––
  • used or attempted to use false document or made a false declaration for the purpose of obtaining the permit or the identity card;
  • committed or attempted to commit any offence punishable under Chapter XII or Chapter XVII of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023) or the Preventionof Corruption Act, 1988 (49 of 1988) or the Customs Act, 1962 (52 of

1962);

  • without sufficient cause, deserted his place of dutyon a vessel or has, refused to discharge his duties on a vessel,

then the issuing authority may, after giving the holder an opportunity of being heard, by order in writing and for reasons to be communicated in writing to the holder, suspend or cancel the permit or identity card for such period as he may specify.

(2) The issuing authority shall––

  • maintain a monthlyreturn relating to identity cards issued under these rules in Form C; and
    • a register of permits or identity cards issued to tindals and other members of the crew of the sailing vessels in Form D.
      1. ––Any person aggrieved by a decision of the issuing authority––
    • refusinghim a permit or an identity card; or
    • issuinghim a permit or an identity card for a period of less than one year; or
    • refusingto renew his permit or identity card or renewing his permit or identity card for a period of less than one year; or
    • suspendingor cancelling his permit or identity card,

may, within a period of thirty days from the date of receipt of the decision of the issuing authority, appeal in writing to the Director-General.

  1. Issueof duplicate permit or identity –– (1) Where a permit or an identity card is lost, destroyed, defaced or mutilated, the holder thereof may apply, along with an affidavit setting out the facts to the issuing authority for a duplicate copy of such permit or identity card accompanied by such fee as specified in Schedule V.

 

  • On receipt of an application, the issuing authority, after satisfying itself as to the correctness of the statements made therein, may issue a duplicate permit or, as the case maybe, an identity card and such permit or identity card shall be marked “DUPLICATE” in red ink.
  • Wherea permit or an identity card which has been stated to be lost or destroyed and in respect of which duplicate has been issued under this rule, is subsequently found, it shall be surrendered to the issuing authority for cancellation.

Explanation.— For the purposes of this Chapter, the term “permit” means the tindal permit issued under rule 48.

 

  1. Statementof –– Every owner or tindal of the vessel shall—
  • maintain or cause to be maintained a statement of the crew as referred to in section 275 of the Act, in Form E appended to the rules;
  • communicate a copy of the statement of the members of crew of the sailing vessel and every change entered therein to the Registrar of the port of registry of the vessel concerned; and
  • producethe statement for inspection on demand by the Registrar, the Regional Officer (Sails) or any other officer authorised in this behalf.
  1. Services, inspection, survey and certification fee.––The fees for services, inspection, survey and certification shall be as specified in Schedule V.

CHAPTER VI

Safety, Manning and Security Requirements

  1. General safety obligations.–– (1)Every sailing vessel shall––
  • at all times maintain a seaworthy condition and be provided with the safety, lifesaving, firefighting, communication and navigational equipment as required under these rules and the notices issued from time to time;
  • maintaina Continuous Synopsis Record (CSR) as per Schedule VI;
  • reportits expected arrival and departure times and dates to the Port Authorities of the port where the vessel is to arrive or depart at least twelve hours prior to the arrival or departure and such information shall be communicated by means of VHF and a document in the approved format through their owners or agents or managers or charterers;
    • maintain an approved ship log book for recording all essential activities and preserving the log books for inspection by the concerned authorities.
      1. Safe–– Every sailing vessel shall carry such minimum number of competent crew as is necessary to ensure––
    • safenavigation and watchkeeping;

 

  • effectiveoperation of sails, rigging and auxiliary machinery;
  • abilityto respond to emergencies including fire, flooding, grounding and man-overboard;
  • continuousradio watch on specified
    1. Watchkeepingand rest –– (1) Continuous navigational watch shall be maintained at all times when the vessel is underway or at anchor in unsafe areas.
  • Thetindal shall assign qualified crew to day and night watches ensuring––
  • thatlookout is maintained by sight and hearing;
  • AISand VHF watchkeeping at all times;
  • wheelor tiller is manned where manual steering is
    • Nowatchkeeper shall be assigned duty if he is unfit due to fatigue, illness or
  • Everycrew member shall be allowed a minimum of––
  • tenhours of rest in any twenty-four-hour period; and
  • seventy-sevenhours of rest in any seven-day period:

Provided that the rest hours may be divided into not more than two periods, one of which shall be at least six hours.

  • Thetindal shall maintain records of watch schedules and rest hours for
    1. Procedure to be followed and additional safety measures.–– Every sailing vessel shall—
  • followthe procedures, in case of maritime security incident, piracy and armed robbery;
  • takeadditional safety measures to prevent piracy, armed robbery incidents, as specified in Schedule IX.
  1. Navigation, reporting and communication.–– (1) Every sailing vessel engaged in international voyages shall keep its AIS (Class A) switched on at all times ensuring realtime monitoring by the relevant authorities.
    • If the AIS (Class A) equipment is switched off or non-operational, the tindal shall manuallyreport the vessel’s position and status to the vessel owner via satellite phone (or other available means) every twelve hours and this information shall be recorded in the official logbook as per Schedule X.
  • Thetindal shall manually report every twelve hours or more frequently in the event of any maritime security threat or safety or security-related incident or when transiting through designated operational risk zones or on the concerned authorities’ request.

Explanation.—For the purposes of this sub-rule, the expression “operational risk zone” means a designated geographical region where specific risks, such as piracy, armed robbery or other security threats, may affect the safety, security, and movement of vessels and trade.

 

 

 

  • Themanual reporting shall contain the following information, namely:––
  • Contactemail of owner;
  • Mobilenumber of owner;
  • Nameof owner;
  • Date andtime of Report;
  • Vesselname;

(f) IMO No.;

  • CallSign;
  • MMSI;

(i) Identity No. or Reg No.;

(j) Latitude, Longitude / Port;

  • Speed;

(l) Course;

  • Total no. of crew and passengers (and details of crew change in last port – if any);
  • Typeof cargo and quantity;
  • Nextdestination port;
  • EstimatedTime of Arrival;
  • Additionalinformation (if any).
    • Alldistress or security alerts shall be notified to Maritime Rescue Coordination Centre (MRCC) or the Maritime and Merchant Data Analytics Centre (MMDAC) or the Information Fusion Centre – Indian Ocean Region (IFC-IOR), as applicable.
      • Any vessel intending to enter a port within the jurisdiction of India shall provide the Pre-Arrival Notification of Security (PANS) information not less than ninety-six hours prior to its anticipated arrival.
      • The Pre-Arrival Notification of Security shall be submitted to the concerned port of arrival and the relevant regional authority through NLP Sagar Setu Portal.
    • Theinformation regarding armed guards on board the vessel when calling Indian Ports or transiting through the Exclusive Economic Zone (EEZ) shall also be forwarded to the Indian Navy, Maritime Rescue Coordination Centre and the local Customs Authority through the vessel’s agent at the concerned port.
    • Thevessels without appropriate documentation shall be permitted to berth only under special circumstances, with prior approval of the Port Facility Security Officer (PFSO):

Provided that such cases should be immediately brought to the notice of the nearest Mercantile Marine Department and the Director-General by the PFSO explaining the circumstances under which the vessel was permitted to enter the port facility limits without PANS reporting.

 

  1. Emergency preparedness and drills.—(1) The Distress Alert Transmitter (DAT) shall be activated bythe tindal or crew of vessel in the event of fire, medical emergency, piracy, sinking or man overboard.
  • Thedistress alerts shall be broadcasted on VHF CH-16 to adjacent vessels by tindal or crew and such alerts shall be sent by all other available means including MF/HF, Satellite Phone, EPIRB, etc.
    • Thetindal shall ensure that drills for fire, abandon ship, flooding, grounding, man-overboard and piracy threats are conducted at intervals not exceeding two months.
  • Duringdrills, the crew shall demonstrate––
  • correct donningand securing of life-jackets;
  • riggingand lowering of survival craft where applicable;
  • operation offire pumps and extinguishers;
  • distresscommunication
    • Arecord of every drill shall be entered in the log book and be produced for inspection on demand.
      1. Responsibilitiesof owner and tindal.– (1) The owner shall ensure that––
    • thevessel has a valid certificate of inspection;
    • theequipment required under these rules is provided and maintained;
    • the crew aretrained and fit for duty;
    • thesecurity and reporting obligations are complied
      • In anyevent, if the annual inspection of sailing vessel is not carried out within twelve months of the date of issue of the previous certificate of inspection due to a sailing vessel being on a voyage outside India, then the owner of the vessel shall submit a statement of compliance and undertaking to the Registrar in the format specified in Schedule XI.
        • The owner shall sensitise the crew about maritime security advisories issued by Director-General and other piracy reporting centres such as IFC-IOR, US MARLO, UKMTO and MSCIO from time to time.
      • The owners shall also inform MMDAC (DGComm Centre) or IFC-IOR or MRCC immediately of any suspicious incident like piracy or armed robbery if reported by the crew to enable prompt action.
      • The owner of the vessel shall provide all safety equipment as required under these
    • The owner shall further ensure compliance with the Customs Act, 1962 (52 of 1962), the Emigration Act, 1983 (31 of 1983), and all applicable rules made thereunder.
    • The tindal shall be responsible for the safe operation of the vessel, crew discipline, compliancewith watchkeeping and security requirements, and immediate reporting of any casualty or defect.
      • The tindal shall ensure that the Automatic Identification System (AIS) (Class A) alwaysremains operational and switched on at sea and if it is deactivated due to

 

extenuating circumstances, the tindal shall inform the MMDAC (DGComm Centre) directly or through the Sailing Vessel Federation or through the vessel owner, providing a valid reason.

  • The tindal shall strictly adhere to maritime security advisories issued periodically by the Director-General to mitigate the risk of piracy or armed robbery incidents.
  • The tindal and crew of the vessel shall promptly report any observed maritime securitythreats, including those related to piracy or armed robbery, to the Sailing Vessel Federation, MMDAC (DGComm Centre) or IFC-IOR or MRCC or as soon as

 

CHAPTER VII

Miscellaneous

  1. –– (1) Every owner of a vessel to which this Chapter applies shall, at all timeswhile the vessel is in operation, maintain a policy of insurance covering every person employed as a member of the crew against death or personal injury arising out of or in the course of employment, including during embarkation and disembarkation.
  • Thepolicy of insurance shall provide for payment of compensation of an amount which shall not be less than the minimum amount specified by the Central Government by notification in the Official Gazette, having regard to international standards, wherever
  • Theinsurance cover shall include the following:––
  • deathof a crew member arising out of employment on board;
  • permanenttotal or partial disability resulting from injury sustained in the course of employment;
  • medical care and treatment for occupational injury or illness until recovery or medical stabilisation;
    • repatriation,including travel and subsistence expenses where discharge or treatment occurs away from the home port; and
  • payment or reimbursement of wages during the period of treatment or untildeclaration of fitness or disability, as applicable.
    • Thepolicy shall be issued by––
  • aninsurer registered with the Insurance Regulatory and Development Authority of India; or
    • amutual protection and indemnity association or club recognised by the Director-General for this purpose.
  • The owner shall ensure that a certificate of insurance issued by the insurer is kept on board the vessel and produced on demand to any proper officer or authority responsible for granting port clearance.
  • No vessel shall proceed to sea unless the vessel is in possession of a valid certificate of insurance of its crew and any vessel not found in possession of such valid certificate may be detained.
  • TheDirector-General may issue guidelines specifying —
  • minimumscope and conditions of insurance;
  • modelpolicy formats;
  • proceduresfor verification during inspection and survey; and
    • additional coverage for vessels operating beyond the Contiguous Zone or on voyages exceeding fourteen days.
      • Where,under the provisions of any other law for the time being in force, compensation is payable in respect of death or personal injury sustained by a member of the crew arising out of or in the course of employment then, if the amount payable under the policy of insurance taken in accordance with this rule —
    • is equal to or greater than the compensation payable under such other law, no compensation shall be payable under such other law;
      • is less than the compensation payable under such other law, the compensation payableunder such other law shall be reduced by the amount paid or payable under the policy.
        1. Trade conditions.—Without prejudice to the generality of the foregoing provisions, for the purpose of promoting the coasting trade, heritage, conservation and preservation, the Director-General may, by order, specify certain commodities to be carried, or any servicesthereto to be performed, through Indian sailing vessels, either generally or in specified sectors of the coasting trade or between specified ports, and the conditions subject to which such reservation may be made, in the public interest or in the interest of sailing vessels:

Provided that due regard shall be had to prevailing and seasonal weather conditions while permitting such transport or performance of such services.

Explanation.— For the purposes of this rule, the expression “coasting trade” shall have the same meaning as assigned to it under the Coastal Shipping Act, 2025 (20 of 2025).

PART I

METHOD OF DETERMINATION OF TONNAGE OF WOODEN SAILING VESSELS

  1. Grosstonnage

The gross tonnage of the vessels, when the hold is clear, shall be determined as per Method I as follows:––

A. For decked vessels.—

  1. Lengths- Measure the length of decked vessels in a straight line along the upper side of the tonnage deck at such a parallel distance from the middle line of the vessel as to clear the several hatchways and other obstacles that may present themselves.
    • Havingfixed upon the ends of this parallel line as for both forward and after as may be found convenient, mark them on deck and transfer them on the middle line of the ship from inside of the stem of to the inside of the midship stern timber or plank, as the case may be.
  • Deductfrom this length what is due to the rake of the bow in the thickness of the
    • Thusrequired length is
      • Where on account of obstruction by hatches, deck-houses, etc., the length cannot be taken in one measurement, then the same can be taken in parts depending on the number of obstructions and these parts shall be subsequentlyadded together to obtain the length.
    • Divide the length so obtained into the number of equal parts required as given in table below––

  1. Depths—The depth of the midship area is to be taken from the underside of the tonnage deck to the upperside of the floor timber, placing the depth measuring rod parallel to the

 

middle place of the ship and also square to the keel by means of a square placed on the upperside of the keel on the keelson.

.1 The depths at the other areas to be taken in a similar manner, taking care where the keel or keelson curves upwards.

  1. Breadths—The depths at any area being ascertained as at paragraph 2 above is divided into required number of equal parts, the points of division at which the breadths are to be taken are to be marked on the rod, and the rod being fixed in its original position, the breadths of the areas are to be taken by extending a tape horizontally thwart through each point, from plank to plank to its average thickness between the respective points of measurements or from inside the frame timbers.

.1 When a batter or spar ceiling is fixed fitted of a greater thickness than 75 millimetres, then 75 millimetres is to be regarded as maximum for which allowance is to be made when measuring the horizontal breadths, but when the thickness is less than this, the actual thickness only is to be allowed.

  1. Transverse areas –– The hold being first sufficiently cleared to admit of the required depths and breadths being properly taken, find in the transverse area of the ship at such point of division the length and the depth is measured at each point of division.
  • In case of a break in the deck, the depth is to be measured below or line stretched in continuation thereof.
  • If the depth at the midship division of the length does not exceed five metres, divide each depth into four equal parts and measure the inside horizontal breadths as mentioned in paragraph 3 at the five points.
  • Measurethe inside horizontal breadths along with the horizontal slide of the measuring rod (Part C) which is to be shifted to the points of divisions and number these breadths from above by numbering the upper breadth one and so on down to the fifth breadth by multiplying the second and fourth by four, the third by two add these products together and to the sum add the first breadth and fifth.
    • Multiply the quantity thus obtained by one third of the common interval of depth between the breadths, and the product shall be deemed the transverse area of the section.
  1. Computation from areas.—The transverse areas at each point of division of the length of vessel as required by the Table at paragraph 1 above, proceed to ascertain the gross tonnage, under the tonnage deck in the following manner, namely:—
  • Numberthe areas respectively 1, 2, 3 etc., 1 being the extreme limit at bow and the last number at the extreme limit of the stern, then multiply the second and every even number area by four and odd number area by two (except the first and last) and add these products together and to the sum add the first and last if they have any value of 1 and

 

multiply the quantity thus obtained by one third of the common interval of the length between the areas, and the product will be the cubical contents of the space;

  • dividethis product by 83 and the quotient being the tonnage under the tonnage deck, shall be deemed to be the gross tonnage of the vessel, subject to any additions or deductions under these rules.
  1. If there be a break, a poop, or any other permanent close in space on the upper deck available for cargo or accommodation of a passengers, the tonnage of that space shall be ascertained as follows :––
  • Measurethe internal mean length of the space and divide it into two equal parts;
  • measure at the middle of its height three inside breadths, such as one at each end and theother at the middle of its length, then to the sum of the end breadths add four times the middle breadths and multiply the whole sum by one third of the common interval between the breadths and the product will give the mean horizontal area of the space;
  • measurethe mean height, and multiply by it the means horizontal area;
  • dividethe product by 83 and quotient shall be deemed the tonnage of the space.
    1. Measurementof machinery space—Measure the mean length, breadth and depth of the machinery space, multiply together these dimensions and divide the product by 2.83 and the result shall be deemed the tonnage of the machinery space.

B. For undecked vessels.—

  1. Thetonnage of undecked vessels shall be determined as in the case of a decked vessel, excepting the measurement of the length and depth.
    • The length of the vessel is to be measured from the meeting of the upper strake to the stem and the stern.
  • Thedepth shall be measured from the top edge of the uppermost strake at each division of length in accordance with the Table under paragraph 1.

The gross tonnage of the vessels, when the hold is not clear, shall be determined as per Method II as follows:––

  1. Forboth decked and open type of vessels, multiply the length for tonnage measurement by the “breadth registered” and also “depth registered”.
  • Dividethe product by 83 and multiply the quotient by 0.7. The result so obtained will be the tonnage of the vessel.
    • Under the tonnage deck calculations for other enclosed spaces for the purpose of arriving at the gross and net tonnage will be same as in the case of Method

 

  1. Nettonnage
  1. The registered or net tonnage of a vessel shall be arrived at after making deductions from the gross tonnage determined in accordance with the provisions of paragraph 1 on account of the following spaces, provided they are reasonable in extent, such as––
  • spacesoccupied solely by the crew and their personal effects;
  • spacesoccupied by vessel’s stores, crew’s provisions, fresh water, sails, ropes and tackles and space required for navigation of the vessel;
  • spacefor machinery and fittings:

Provided that no deductions shall be made on account of any space, unless it has previously been included in the gross tonnage.

All measurements for the purpose of ascertaining the tonnage of a vessel shall be in metres and fractions of a metre upto the nearest centimeters.

Note: The tonnage measurement of a vessel shall be entered in Form SVT-1.

 

PART II

METHOD FOR COMPUTATION OF FREEBOARD

Where ––

F = Free board in centimetres from top to permanent gunwale at side (for open sailing vessels) or top of deck at side amidships to the centre of the disc.

L = Length for free board in metres – 0.21K + 0.8LD

LLK= Length of straight keel in metres between points where the line of stem and stern (extended downwards if necessary) meet the line of keel.

LD= Length of the vessel in metres from forepart of the stem to the after part of the stern post measured at the level of deck on centreline in the case of a decked vessel and in the case of open vessels from where the line of permanent gunwale level, the measurement being taken in a straight line.

D=Depth of the vessel amidships in metres from top to keel to the top of free board deck at side in the decked vessels or top of permanent gunwale in open vessels.

Explanation.— For the purposes of this Part, the expression “freeboard deck” means the uppermost complete deck having permanent means of closing all the openings on the weather part of the deck.

 

Note:

  • Where depth “D” exceeds L/6, the difference in actual depth and L/6 will be added to the free board obtained by the relevant formulae.
  • Thefree board referred to above shall be free board in saltwater, the free board in fresh water of unit density shall be less than the free board in salt water by five
    • Final free board shall be assigned with the addition of such amount of free boardas the assigning authority may determine having regard to the classification, construction, age and other conditions of the vessel.

 

 

 

  • The hatch coaming in decked vessel shall be at least 45 centimetres high and ofsubstantial construction. Covers for hatchways openings shall be efficient with means of battening down weathertight.
  • Sailing vessels built prior to 1st January, 1961 and specially built for carriage of logs having opening in the sides of the sailing vessel closed by temporary structures and having a depth less than L/10 maybe assigned free board at 1/3 of the free board obtained by formulae (A) provided that the temporary structure having a height of not less than (25D + 30) cms is constructed efficiently to the satisfaction of the surveying  Where the depth “D” of the vessel is more than L/10 or the height of the temporary structure at side is less than (25D + 30) cms or is not efficient the free board may be increased.

Part 1 Emergency drills and Training

 

  • Drillsshall, as far as practicable, be conducted as if there were an actual
  • Every crew member shall participate in at least one abandon vessel drill and one fire drill every month.
  • The drills of the crew shall take place within twenty-four hours of the vessel leaving a port if more than 25% of the crew have not participated in abandon vessel and fire drills on board that particular vessel in the previous month.
  • When a vessel enters service for the first time, after modification of a major character or when a new crew is engaged, these drills shall be held before sailing.
    • The Director-General may accept other arrangements that are at least equivalent for those classes of vessels for which this is impracticable.
      • Crewmembers with enclosed space entry or rescue responsibilities shall participate in an enclosed space entry and rescue drill to be held on-board the vessel at least once every two months.
        • Abandonvessel drill
      • Eachabandon vessel drill shall include––
    • summoningof crew to muster stations with the alarm followed by drill announcement on the public address or other communication system and ensuring that they are made aware of the order to abandon vessel;
    • reportingto stations and preparing for the duties described in the muster list;
    • checkingthat crew are suitably dressed;
    • checkingthat lifejackets are correctly donned;
    • loweringof at least one lifeboat after any necessary preparation for launching;
    • startingand operating the lifeboat engine;
    • amock search and rescue of passengers trapped in their staterooms; and
    • instructionin the use of radio life-saving

 

 

 

  • Different lifeboats shall, as far as practicable, be lowered in compliance with the requirements of paragraph 1.4.1.5 at successive drills.
  • Except as provided in paragraphs 1.4.4 and 1.4.5, each lifeboat shall be launched, and maneuvered in the water by its assigned operating crew, at least once every three months during an abandon vessel drill.
    • The Director-General may allow vessels operating on short international voyages not to launch the lifeboats on one side if their berthing arrangements in port and their trading patterns do not permit launching of lifeboats on that side provided that allsuch lifeboatsshall be lowered at least once every three months and launched at least
  • As far as is reasonable and practicable, rescue boats other than lifeboats which are also rescue boats, shall be launched each month with their assigned crew aboard and maneuvered in the water at least once every three months.
    • If lifeboat and rescue boat launching drills are carried out with the vessel making headway, such drills shall, because of the dangers involved, be practiced in sheltered waters only and under the supervision of an officer experienced in such drills.
  • Emergencylighting for mustering and abandonment shall be tested at each abandon vessel drill.
    • Firedrills
  • Fire drills shall be planned in such a way that due consideration is given to regular practice in the various emergencies that may occur depending on the type of vessel and the cargo.
  • Eachfire drill shall include––
  • reportingto stations and preparing for the duties described in the muster list;
  • starting of afire pump, using at least the two required jets of water to show that the system is in proper working order;
  • checkingof fireman’s outfit and other personal rescue equipment;
  • checkingof relevant communication equipment;
  • checkingthe operation of watertight doors, fire doors, fire dampers and main inlets and outlets of ventilation systems in the drill area; and
    • checkingthe necessary arrangements for subsequent abandoning of the
      • The equipment used during drills shall immediately be brought back to its fully operational condition and any faults and defects discovered during the drills shall be remedied as soon as possible.

 

  • Enclosedspace entry and rescue drills
  • Enclosed space entry and rescue drills shall be planned and conducted in a safe
  • Eachenclosed space entry and rescue drill shall include––
  • checkingand use of personal protective equipment required for entry;
  • checkingand use of communication equipment and procedures;
  • checkingand use of instruments for measuring the atmosphere in enclosed spaces;
  • checkingand use of rescue equipment and procedures; and
  • instructionsin first aid and resuscitation  2 On-board training and instructions
    • On-board training in the use of the vessel’s life-saving appliances, including survival craftequipment, and in the use of the vessel’s fire-extinguishing appliances shall be given as soon as possible but not later than two weeks after a crew member joins the vessel.
  • However, if the crew member is on a regularly scheduled rotating assignment to the vessel, such trainingshall be given not later than two weeks after the time of first joining the vessel.
    • Instructions in the use of the vessel’s fire-extinguishing appliances, life-saving appliances, and in survival at sea shall be given at the same interval as the drills.
  • Individual instruction may cover different parts of the vessel’s life-saving and fire-extinguishingappliances, but all the vessel’s life-saving and fire-extinguishing appliances shall be covered within any period of two months.
    • Everycrew member shall be given instructions which shall include but not necessarily be limited to––
  • operationand use of the vessel’s inflatable life rafts;
    • problems of hypothermia, first-aid treatment for hypothermia and other appropriate first-aid procedures;
    • special instructions necessary for use of the vessel’s life-saving appliances in severe weather and severe sea conditions;
  • operationand use of fire-extinguishing appliances; and
  • risks associated with enclosed spaces and on board procedures for safe entryinto such

 

  • On-board training in the use of life rafts shall take place at intervals of not more than four months on every vessel fitted with such appliances.

.1 Wherever practicable, the drill shall include the inflation and lowering of a life raft which may be a special life raft intended for training purposes only, which is not part of the vessel’s life-saving equipment and such a special life raft shall be conspicuously marked.

  • Records
  • Thedate when musters are held, details of abandon vessel drills and fire drills, enclosed space entry and rescue drills, drills of other life-saving appliances and onboard training shall be recorded in such log-book as may be specified by the Director-
    • Ifa full muster, drill or training session is not held at the appointed time, an entry shall be made in the log-book stating the circumstances and the extent of the muster, drill or training session held.

  • Every such vessel shall carry lifebuoys complying with the requirements specified in the Life Saving Appliances Code.

 

  • Theminimum number of lifebuoys to be carried on every such vessel shall be in accordance with the following Table, namely:—

  • Thelifebuoys shall be—

 

  • so distributed that theyare readily available on both sides of the vessel and so stowed as to be capable of being readily cast loose; and
    • fittedwith a buoyant lifeline complying with the requirements specified in these rules.

 

  • At least one-half of the lifebuoys shall be fitted with self-igniting lights complyingwith the requirements specified in these rules.

 

 

  • Every such vessel of sixty metres or more in length shall carry one lifebuoy on the navigationbridge capable of being released with a self-activating smoke signal complying with the requirements specified in these rules.

 

  • Every such vessel shall carry lifejackets equal to the number of persons it is certified to carry, complying with the requirements specified in these rules, and such lifejackets shall be so placed as to be readily accessible and their location clearly indicated.

 

  • Inevery such vessel,—

 

  • the tindal shall provide to every person on-board clear instructions to be followed in the event of an emergency;

 

  • atleast two certificated persons shall be carried to take charge of survival craft and to assist and train other untrained persons;

 

  • eachmember of the crew shall possess a certificate indicating attendance at an approved course on personal survival techniques;

 

  • thecrew shall practise the procedure for abandoning vessel and the use of lifesaving appliances at least once every fifteen days; and

 

  • the tindal shall ensure that all life-saving appliances are in working order and ready for immediate use when the vessel leaves port and at all times during the

 

Part 3

Additional requirements for vessels of more than sixty metres in length

 

Every vessel of more than sixty metres in length shall carry—

 

  • either a rescue boat or a Class ‘C’ boat complying with the following requirements, namely:—

 

(i) an open boat constructed with rigid sides;

 

  • suchform and proportions as to have ample stability in a seaway and sufficient freeboard when fully loaded with the maximum number of persons for whom seating is provided and its full equipment;

 

  • notless than 3 metres and not more than 5.5 metres in length;
    • fitted with thwarts and side seats placed as low as practicable and provided with bottom boards; and

 

  • fitted with internal buoyancy so arranged as to ensure stability when fully loaded under adverse weather conditions, consisting of air cases constructed of copper, muntz metal, or other equally suitable material;

 

  • life rafts of sufficient aggregate capacity to accommodate all persons the vessel is certified to carry;

 

  • a survival craft emergency position-indicating radio beacon complying with the applicablerules made under the Act, stowed in a protected and readily accessible position and capable of being transferred to any survival craft in an emergency; and

 

  • one manually operated locating device in compliance with the applicable rules made under the Act, so stowed as to be readily placed in any survival craft.

 

Part 4 Requirements for vessels of less than sixty metres in length

Every vessel of less than sixty metres in length shall carry life rafts of sufficient aggregate capacity to accommodate all persons the vessel is certified to carry:

 

Provided that every such vessel of less than forty meters in length may carry in lieu of life rafts a boat complying with the requirements specified in the rules for Class ‘C’ boat.

 

Part 5

Muster list and emergency instructions

  1. ThisPart applies to all sailing
  2. Clear instructions to be followed in the event of an emergency shall be provided for every person on-board.
  3. Musterlists and emergency instructions complying with the requirements of these rules shall be exhibited in conspicuous places throughout the vessel including the navigation bridge, engine-room and crew accommodation spaces.

Schedule IX [See rule 60(b)] Part I

Procedures to be Followed during a maritime security incident

  1. In the event of a maritime security incident occurring anywhere in the world, the following steps shall be taken to ensure a coordinated, effective, and timely response, namely:––
    • Contact the nearest Indian Navy vessel or any other warships (or any Indian Coast GuardVessel) in vicinity using VHF, provide the current location, describe the situation, communicate the intended course of action, and seek further guidance.
  • Informthe owner of the vessel, who can convey the information immediately by to the following centres, namely:––
  • Information FusionCentre -Indian Ocean region (IFC-IOR);

(ii) Mercantile Marine Domain Awareness Centre (MMDAC -DGComm Centre);

  • MaritimeRescue Coordination Centre (MRCC) is also to be informed if the vessel is located within the Indian Search and Rescue Region (ISRR).
    • MMDAC (DGComm Centre) shall promptly relay it to all concerned agencies and stakeholders to ensure a coordinated response and situational awareness.
    • As soon as the situation allows, a first information report shall be transmitted by the vessel owners to the MMDAC (DGComm Centre).

Part II

Procedures to be followed during a piracy or armed robbery attack

  1. Allowners of mechanised sailing vessel shall ––

(a) inform the MMDAC (DGComm Centre) or IFC-IOR or MRCC immediately of any piracy or armed attack or suspicious incident as soon as he receives communication from the vessel crew and the first recipient amongst the mentioned agencies will relay the information to the other agencies;

  • inform the port of departure and next port of call, the safety and communication equipment fitted on board, and the quantity of fuel available on board;

 

  • providethe details of the cargo, no. of the crew with their names and passport details along with photographs to MMDAC (DGComm Centre);
  • inform the families of the crew about the piracy or armed robbery incident once confirmed and appraise them to remain calm and take necessary action in hand for the release of the crew from the custody of the perpetrators;
  • provide information regarding the ransom demanded by pirates and the status of negotiations with them to DG Shipping;
  • provide information regarding the release of the crew after the hijack and the circumstances under which they were released;
  • producethe crew of the vessel in front of security agencies and MMD after their release from the hijack for their statements and debriefing.

2. All crew of mechanised sailing vessel shall ––

  • activatethe DAT indicating a piracy or armed robbery attack;
    • in the event that a vessel does not have a satellite phone, any such attack information shall be transmitted usingthe MF/HF Transceiver available onboard and the vessels may establish HF radio contact (if the other vessel is outside of VHF range) with each other to relay emergency messages.
      • if a vessel is suspected to be under a piracy or armed robbery attack, the vessel shall immediatelyrelay the distress message via MF/HF transceiver to its owners, providing the following details:

(i) Name of the sailing vessel

  • CallSign
    • Position of thevessel
    • Anyother relevant information
  1. Uponreceipt of the distress message, the vessel owner shall immediately––
  • conveythe message by telephone to MMDAC (DGComm Centre) or IFC-IOR or MRCC. The first recipient amongst the mentioned agencies will relay the information to the other agencies.
  • whensituation permits, send an email to MMDAC (DGComm Centre) with all relevant details of the incident and the MMDAC (DGComm Centre) shall––

 

  • inform immediately the concerned ministries, security agencies and other applicable stakeholders by the quickest possible means including telephone or
    • contact the nearest Indian Navy or Indian Coast Guard vessel or coalition warship using VHF Channel 16, provide the current location, describe the situation, communicate the intended course of action, and seek further guidance.
  1. Thecrew of the vessel shall––
    • communicate the current location of the vessel as soon as possible when a threat of piracy or armed robbery is observed at sea immediately to the Sailing Vessel Federation or owner or MMDAC (DGComm Centre) or IFC-IOR or MRCC;
  • tryto convince pirates to talk to the owner and concerned authorities; and
    • communicate to nearby foreign or Indian authorities about their captive location at every possible opportunity they get. For that, the tindal of the vessel should be updated with contact number of MMDAC (DG Com Centre), IFC-IOR, MRCC and Indian Embassy near to next port of call, port authority of the next port of call and other international authority related to piracy or armed robber cases.

 

Part III

Additional safety measures to prevent piracy or armed robbery incidents

 

  1. As additional security measures, a vessel may carry the following security equipment as applicable, namely:––
  • GeneralAlarm (to alert all crew members);
  • Search Light(for patrolling or search in dark hours);
  • Whistles (foralerting the crew);
  1. If likelyto sail or transit through the passage in known piracy or armed robbery areas, the tindal of vessel should ensure to take the International Recommended Transit Corridor (IRCTC) or similar transit corridors and the vessels which are utilising such convoys are advised to wait at the collection or starting point and start together with other vessels at the beginning of the convoy.
    1. In suspected piracy or armed robbery areas, the tindal shall ensure that a continuous watchis maintained by the vessel crew around and any suspicious movements shall be

 

immediately reported to the tindal, who shall take all appropriate safety measures to safeguard the vessel and crew.

  1. Duringdark hours, if any suspicious movement is observed, the vessel crew shall closely monitor the activity and shall––
  • immediatelyswitch on the high-beam torch to illuminate the area;
  • alertall crew members using whistles or other effective means of Communication;
  • ensurethat the vessel remains in a heightened state of alertness to deter any approaching suspicious boats from attempting unauthorised boarding.
