Under the new Income-tax Rules, 2026, Form No. 181 replaces the old Form 10BC. It is governed by Schedule VIII [Table: Sl. No. 2] of the Income-tax Act, 2025, and Rule 289(1) of the Income-tax Rules, 2026.

1. Purpose of the Form Form 181 serves as the mandatory audit report for an electoral trust. Its primary purpose is to allow the electoral trust to officially claim that the voluntary contributions it received should not be included in its total income.

2. Applicability (Who Should File) It must be filed by an Accountant (as defined in section 2(1) of the Act) who has audited the books of account of the electoral trust.

3. Frequency and Due Dates

  • Frequency: It is an annual form filed for a given tax year.
  • Due Date: It must be filed prior to or on the due date of filing the return of income under section 263(1) of the Act.

4. Mode of Filing and Rules

  • Online Only: Form 181 must be furnished electronically on the e-filing portal to the Commissioner of Income Tax (CPC). It cannot be filed offline.
  • PAN Requirement: A valid PAN is strictly mandatory; the form cannot be filed without it.
  • No Edits Allowed: Once the form is submitted, it cannot be edited, so all details must be correct prior to submission.

5. Structure of the Form The audit report captures the following critical details:

  • A formal declaration by the accountant. If the accountant answers any matter in the negative or with a qualification, they must state the reasons for it within the report.
  • Details of the voluntary contributions received and distributed.
  • Details of the application of funds in respect of the benefit of persons or interested persons referred to in Rule 289(10).
  • Details of the expenditure incurred towards the administration or management of the electoral trust’s affairs.

6. Process Flow and Outcome The accountant prepares the report by furnishing the required declarations and financial details regarding contributions, administrative expenditures, and benefits to interested persons. Upon successful filing and processing, the electoral trust is legally permitted to claim the reported voluntary contributions as exempt (not included in the total income) in its return of income.
