  • Is it Mandatory? Yes, filing Form 182 is strictly compulsory. Without furnishing this audit report, the taxpayer’s deduction is liable to be disallowed.

3. Frequency and Due Dates

  • Frequency: The form is furnished annually.
  • Due Date: It must be filed one month prior to the due date for furnishing the return of income under Section 263(1) of the Income-tax Act, 2025.

  • Computation of the deduction under Section 48 and Schedule IX compliance evidence.

6. Process Flow for Filing

  • Initial Step: The assessee must first deposit the eligible amounts into a “Special Account” with NABARD or an approved “Deposit Account” (e.g., approved by the Tea, Coffee, or Rubber Board).
  • Audit & Online Preparation: The Chartered Accountant audits the accounts and prepares the e-form on the Income Tax e-filing portal. The CA must mandatorily enter their Membership Number, Firm Registration Number, and generate a Unique Document Identification Number (UDIN) within the form.
  • CA Signature: The CA digitally signs the form using a Digital Signature Certificate (DSC) and uploads it.
  • Taxpayer Acceptance: Finally, the assessee must log into their own e-filing account and electronically “Accept” the uploaded form to complete the statutory filing process.

  • Outcome: Successful processing of Form 182 enables the assessee to claim the deduction under Section 48, which allows up to 40% of the profits derived from the business, subject to the amount actually deposited.
  • Updates in the 2026 Rules: The old form (Form 3AC) relied heavily on free-text boxes. The new Form 182 has structured this data into tabular formats to greatly simplify compliance, data extraction, and validation. Additionally, anomalies caused by grouping fields together have been fixed by separating Name, Designation, Address, PAN, and Aadhaar into distinct boxes.
