NOTIFICATION
New Delhi, the 21st August, 2026
G.S.R. 756(E).— In exercise of the powers conferred by sub-section (1) and clauses (a) to (z), (za) and (zb) of sub-section (2) of section 44 of the Merchant Shipping Act, 2025 (24 of 2025) and in supersession of the Merchant Shipping (Registration of Indian Ships) Rules, 1960, as amended, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely:––
Chapter – I Preliminary
- Shorttitle and –– (1) These rules may be called the Merchant Shipping (Registration of Vessels) Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
- ––These rules shall apply to all sea-going vessels, except sailing vessels:
Provided that these rules shall also apply to fishing vessels for the purposes of sub-rule (1) of rule 4.
- ––(1) In these rules, unless the context otherwise requires,––
- “Act”means the Merchant Shipping Act, 2025 (24 of 2025);
- “authorised agent” means any person authorised by the ship owner or the charterer, as the case may be, to act on their behalf;
- “builder’scertificate” means a certificate issued by the shipbuilder or shipyard or the recognised organisation, specifying the details of the vessel and its year of build, at the time of delivery of a newly constructed vessel, certifying that the vessel has been completely built, fitted, and equipped in accordance with the approved plans and specifications;
- “carvingand marking note” means the official document issued by the Registrar after a vessel’s registration particulars are provisionally approved, instructing the owner to carve or mark the vessel’s name, official number, and port of registry on the hull, as specified under sub-rule (2) of rule 9;
- “central register” means the register book in physical or digital format provided in Form 1 maintainedby the Director-General, which shall contain all the entries recorded in the register books maintained by the Registrars;
- “certificate of registration” means the certificate issued by the Registrar to the ship owner, confirming the lawful registration of the vessel with the port of registry;
- “certificate of survey” means a certificate issued by a surveyor upon completion of the survey of a vessel under rule 10;
- “Form”means a Form appended to these rules;
- “carvingand marking note” means the official document issued by the Registrar after a vessel’s registration particulars are provisionally approved, instructing the owner to carve or mark the vessel’s name, official number, and port of registry on the hull, as specified under sub-rule (2) of rule 9;
- “firstregistry” means a vessel being registered under the provisions of these rules in the register book for the first time;
- “Act”means the Merchant Shipping Act, 2025 (24 of 2025);
- “Flag State Administration” means the government or maritime administration of the country whose flag the vessel is entitled to fly, or under whose authority it is operating;
- “Indiancontrolled tonnage vessel” means Indian controlled tonnage vessel as defined under subsection (3) of section 2 of the Act;
- “MMSI” means the Maritime Mobile Service Identity which is a series of nine digits sent in digital form over a radio frequency channel in order to uniquely identify a vessel or a station;
- “recognisedorganisation” means a classification society or other body recognised by the Central Government for the purpose of performing statutory surveys, audits, inspections, approvals and certification functions on behalf of the Central Government;
- “register book” means the book in digital format as provided under rule 4, and maintained by the Registrar in accordance with sub-section (9) of section 20 of the Act;
- “registeredlength” means the length as defined under the Merchant Shipping (Load Line) Rules, 2026;
- “re-registration” means the registration of a vessel that was previously registered under the Indianflag, the registration of which had been closed or deleted on account of abandonment, sale or transfer to a foreign flag, subsequent registration under a foreign registry, or for any other reason as may be considered appropriate by the Director-General, and which is thereafter sought to be registered again under the Indian flag in accordance with these rules;
- “Schedule”means the Schedule appended to these rules;
- “technical clearance” means the clearance granted by the Registrar of the intended port of registry, after additional review and inspection of the vessel as may be specified by the Director-
(2) The words and expressions used, but not defined in these rules, and defined in the Act, shall have the same meanings respectively assigned to them in the Act.
Chapter – II Registration of Vessels
- Register–– (1) Every Registrar shall keep a book to be called the register book in a digital format and make entries therein in Form 1 in the following manner, namely:––
- theproperty in a vessel shall be divided into one hundred shares;
(b) with respect to joint owners or owners by transmission, not more than one hundred persons shall be entitled to be registered at the same time as owners of any one vessel:
Provided that the proportion of ownership shall be as specified in the notification issued under sub-section (1) of section 15 of the Act:
Provided further that nothing in this rule shall affect the beneficial interest of any number of persons represented by, or claiming under or through, any registered owner or joint owner;
- aperson shall not be entitled to be registered as owner of a fractional part of a share in a vessel;
(d) joint owners shall be considered as constituting one person and not be entitled to dispose of, severally, any interest in a vessel or any share therein in respect of which they are registered.
(2) Any person may make an application to the Registrar through the online platform, and upon submission of a valid Identity document issued by the Government and payment of the fees as specified in Schedule, inspect the register book or obtain a certified copy of any entry therein, in the format specified in Form 2.
- Application for registration of vessels.–– (1) The owner or the authorised agent of a vessel intended to be registered as an Indian vessel shall make an application to the Registrar in Form 5.
(2) No vessel shall be required to be physically present at any port in India, nor shall it be required, after registration, to call at any port in India, solely for the purpose of registration under these rules.
- Ageof –– The Director-General may by order specify,––
- theage criteria for any vessel for the purposes of obtaining registration;
- in respect of any vessel to which the age criteria do not apply, the age for obtaining technical clearance for the purpose of applying for registration.
Explanation.—For the purposes of this sub-rule, the term “age” means the period calculated from the date on which the vessel was delivered by the builder to the ship owner, as recorded in the builder’s certificate or the date of delivery as in the safety construction certificate as applicable.
- Declarationof – (1) Every declaration of ownership shall be made in Form 3 before a Registrar or Special Executive Magistrate or Commissioner of Oaths or Indian Ambassador or Surveyor:
Provided that where such a declaration is made outside the port of registry, the place of attestation shall be specified therein.
(2) The declaration may be submitted either online or in person.
- Name of vessel, official number, MMSI number and call sign. – (1) The ship owner or the authorised agent, shall make an application to the Registrar at the intended port of registry, by electronicmeans, proposing the name of the vessel and requesting allotment of an official number, at least seven days prior to the date on which the ship owner desires to effect the registration:
Provided that the Registrar may, in exceptional cases, reduce the requirement of seven days to not less than one day.
- Theship owner or the authorised agent may, along with such application, also apply for allotment of MMSI number and call sign for the vessel.
- Upon receipt of such an application, the Registrar shall, after verification of the requisite particulars, grant approval of the proposed name and proceed with the allotment of the official number, MMSI number and call sign in Form 4, subject to being satisfied that the proposed name is not identical with or deceptively similar to the name of any other vessel registered in India and that the vessel complies with the provisions of sub-section (1) of section 15 of the Act.
- Upon allotment of the official number, MMSI number and call sign, the ship owner or the authorisedagent shall make an application for registration of the vessel in Form 5 within such period not exceeding two years from the date of such allotment.
- Theperiod of validity of the approved name, MMSI number and the call sign shall be two years from the date of their allotment under sub-rule (3):
Provided that the Registrar may, upon an application made by the ship owner or the authorised agent before the expiry of such period of validity and on payment of the fees specified in the Schedule, renew the approval of the name, MMSI number and call sign for a further period of one year at a time.
- Markingof –– (1) Upon approval of the vessel’s name and allotment of the official number by the Registrar under rule 8, a carving and marking note shall be issued to the ship owner or the authorised agent in Form 6 specifying the particulars and locations of the markings to be made on the vessel.
- Everyvessel shall, before registration, be marked permanently and conspicuously, in accordance with the particulars set out in the carving and marking note to the satisfaction of the Registrar in the following manner, namely:––
- thename of the vessel and the port of registry shall be painted on the port and starboard bows and on the stern;
- the markings shall be made in Hindi and English, with the Hindi inscription placed abovethe English inscription, and the letters shall be painted on a dark background in white or yellow colour, or on a light background in black colour, wherein the minimum height of the letters shall be 10 centimetres and the minimum width shall be 1.3 centimetres;
- where, due to structural constraints, sufficient space is not available on the stern for painting the name and port of registry, the same may be painted on both quarters of the vessel;
- the official number and the number denoting the registered tonnage shall be engraved on a brass plate 30 cm x 6 cm wide, and the same shall be affixed in a conspicuous place on the navigation bridge of the vessel.
Explanation.–– For the purposes of this clause, the expression “registered tonnage” means the gross and net tonnage of a registered vessel as provided in the tonnage certificate in accordance with clause (b) of sub-section (5) of section 20 of the Act;
- the scale of draught marks shall be cut off or welded in metres and decimetres both forward and aft on the port and starboard side respectively;
- incase of vessels having a raked soft stem and cruiser stern, the marks shall be cut in or welded as close and aft of the stem as possible, following the contour of the stem, and the marks aft, or at the stern, shall be cut not more than 2 metres forward of the after perpendicular; and
- where the vessel has been assigned an International Maritime Organization ship identification number, such markings shall be made permanently in a manner that it is plainlyvisible and distinct, free from obstruction or interference by any other markings,
and shall be painted in a contrasting colour where the height of such markings shall not be less than 200 millimetres on the exterior of the vessel and 100 millimetres in internal locations, and the marking shall be made by raised lettering, cutting, centre-punching, or an equivalent permanent method in accordance with SOLAS regulation XI-1/3, as amended from time to time.
- The owner or the authorised agent shall return the carving and marking note to the Registrar after the carving and marking have been duly completed and certified by a surveyor.
- Surveyand – Upon satisfaction of the evidence of ownership, the Registrar shall have the vessel surveyed by a surveyor and the tonnage ascertained in accordance with the applicable rules made under the Act, and upon completion of the survey of the vessel, the surveyor shall issue a certificate of survey in respect of the vessel in Form 7 to the owner or the authorised agent.
- Survey of vessels at ports outside India. – Where it becomes necessary for a vessel to be surveyedfor purposes of registration at a port outside India, the Registrar may depute a surveyor or request the Government of the country where the vessel is lying, to appoint a qualified surveyor to conduct a survey of the vessel for the issuance of a certificate of survey and carving and marking
- Certificate of registration.–– The Registrar shall cause the particulars of the vessel to be entered in the register book and shall thereupon issue a certificate of registration in Form 9 upon production to the Registrar of the following documents, namely:–
- Builder’sCertificate or Safety Construction Certificate, as applicable;
- Instrumentof Sale, as applicable;
- DeletionCertificate, as applicable;
- Carvingand Marking Note;
- Declarationof Ownership;
(f) Certificate of Survey; and
- documentaryproof of eligibility under sub-section (1) of section 15 of the
- Instrumentof – (1) A transfer of a registered vessel or any share therein shall be effected by an instrument of sale in Form 8.
- Inthe case of joint ownership or multiple owners, all the owners shall jointly execute the instrument of sale.
- Allrecords of subsequent sale transactions shall be made in the following manner, namely:–
- for vessels transferred by sale from one Indian owner to another Indian owner, thechange of ownership shall be declared before the concerned Registrar, and all
document requirements along with the fees specified in the Schedule shall be complied with as provided in these rules; and
- alltransactions under this rule shall be recorded in the register book and reported to the Director-General.
- Registrationof a Government vessel. – A Government vessel may be registered and issued the certificate of registration in accordance with the provisions of rules 5 to 13, subject to the following conditions, namely:––
- the application for registration shall be made by the Secretary of the Ministry or the Head of the Department concerned or by any other officer nominated in this behalf by the Central Government or the State Government or the Union territory Administration, as the case may be;
- thetransfer of a registered Government vessel shall be made by an instrument of sale in the appropriate registry form, omitting the covenant contained therein and be signed by the transferor or by a person duly authorised by the Central Government or the State Government or the Union territory Administration:
Provided that the requirement of technical clearance and declaration of ownership referred to in rules 6 and 7 respectively shall not apply for the purposes of registration under this rule.
Explanation.—For the purposes of this rule, the expression “Government vessel” means a vessel belonging to the Central Government or State Government or Union territory Administration, other than a vessel of Indian Navy, Indian Coast Guard, customs authorities, Central Armed Police Forces and police.
- Registration of bareboat charter-cum-demise. – (1) Where a foreign vessel is chartered on bareboat charter-cum-demise to any of the persons specified in sub-section (1) of section 15 of the Act, the charterer orthe authorised agent shall make an application for registration to the Registrar in accordance with these rules which shall be accompanied by the following documents, namely:–
- in lieu of the instrument of sale, a certified copy of the charter-party agreement, which shall distinctly set forth the name of the vessel, the name of the charterer and owner, the date of the charter-party and the period of the charter;
- a copy of certificate of registration with written confirmation issued by the primary registry, certifying that the right of the vessel to fly the flag of the primary registry shall remainclosed or suspended for the duration of the bareboat charter-cum-demise registration in India;
- awritten consent or no objection letter from every registered mortgagee or holder of any lien, registered charge or encumbrance in the primary registry, acknowledging the proposed bareboat charter-cum-demise registration in India and confirming that the mortgage or charge will continue to attach to the vessel; and
- a transcript or certified extract of the register from the primary registry showing the ownership, encumbrances, lien, and other relevant particulars of the vessel.
- TheRegistrar shall ensure that the suspension or non-operation of the previous registry is carried out to the satisfaction of the Registrar who shall then––
- enterthe particulars of the vessel and the charterer in the register book;
- identify the entry as a bareboat charter-cum-demise registration, with a clear reference tothe primary registry and to any existing mortgages or encumbrances in that registry; and
- issue a certificate of registration in Form 9 in favour of the charterer indicating that it relates to a bareboat charter-cum-demise registration and specifying the date of expiry of such registration.
- An Indian chartered foreign vessel registered under bareboat charter-cum-demise contract shall fly exclusively the flag of India during the term of registration under these rules.
- A vessel registered under a bareboat charter-cum-demise contract shall be entitled to the Rightof First Refusal having priority over non-Indian vessels and rank lower than that accorded to Indian controlled tonnage vessels.
- No transfer of ownership of a vessel registered under a bareboat charter-cum-demise arrangementshall be effected by virtue of registration under this rule, and no entry shall be made in the register book that purports to transfer legal title in derogation of the ownership recorded in the primary registry.
- Any sale or transfer of ownership which is recorded in the primary registry shall also be recorded in the register book if the bareboat charter-cum-demise is continued.
- Registration of vessels abandoned in Indian waters. – A vessel abandoned in Indian waters which is subsequently acquired by a person eligible to register a vessel in accordance with these rules may be registered or re-registered by the ship owner or the authorised agent, subject to technical clearance and physical inspection by a surveyor.
- Indian controlled tonnage vessel. – (1) The aggregate tonnage of foreign-flag vessels owned or controlled by persons specified in sub-section (1) of section 15 of the Act, shall not exceed the aggregate tonnage of vessels registered under the Indian flag owned or controlled by such person.
- Every Indian controlled tonnage vessel shall ensure that at least fifty per cent. of its total crew, including officers and ratings, engaged on board the vessel in accordance with the Safe Manning Documentor actual deployment, whichever is higher, shall be Indian nationals holding valid Indian certificates:
Provided that where the law of the flag State of such vessel or local regulations applicable at the place of its deployment, require the engagement of crew of a particular nationality such that compliance with the fifty per cent. requirement of Indian nationals under this sub-rule is not possible, the obligation under this sub-rule shall stand relaxed to the extent necessary to comply with such law or regulation.
- Everyship owner having an Indian controlled tonnage vessel shall furnish, by electronic means, on or before the first day of April and the first day of October of each year, particulars relating to,—
- deploymentof Indian crew and trainees in accordance with sub-rule (2); and
- detailsof all Indian controlled tonnage vessels registered under a foreign
- Any Indian controlled tonnage vessel operating under a charter arrangement and granted a licence under section 4 of the Coastal Shipping Act, 2025 (20 of 2025), shall be accorded priority over non-Indian vessels and be entitled to the Right of First Refusal, ranking immediately after Indian-flagged vessels.
- A person specified under sub-section (1) of section 15 of the Act acquiring its first Indian controlled tonnage vessel may register such vessel under a foreign flag:
Provided that where a vessel is so registered, such person shall register the said vessel, or another vessel of equivalent tonnage, under the Indian flag within a period of two years from the date of registration of the vessel under the foreign flag.
- Wherea vessel registered under a foreign flag under sub-rule (5), or equivalent tonnage referred to therein, is not registered under the Indian flag within the specified period, such person shall be liable to penalty under rule 43:
Provided that the provisions of this entire rule 17 shall not apply to a financial institution for registering a vessel in a State other than India.
Explanation.–– For the purposes of this rule, the expression “financial institution” means a unit set up in International Financial Services Centre at the Gujarat International Finance Tec-City (GIFT), Gandhinagar, Gujarat, which is engaged in rendering financial services in respect of any financial product as per the provisions of the International Financial Services Centres Authority Act, 2019 (50 of 2019).
- Provisional certificateof – Where, pursuant to an application for registration made before the Registrar, a vessel cannot be issued a regular certificate of registration due to non-availability of deletion certificate from its previous registry or for any other reasons to be recorded, the Registrar may issue a provisional certificate of registration in Form 10.
- Temporarypass in lieu of certificate of – (1) Where there is a delay in the grant of the certificate of registration and it appears to the Registrar that, for reasons to be recorded, it is desirable that permission be granted for a vessel to be registered as an Indian vessel to proceed on a voyage to, or between, ports in India or to its intended port of registry, or in any other appropriate circumstances as the Director-General may deem fit, the Registrar shall issue a temporary pass under section 21 of the Act in Form 11 which shall be valid for such period not exceeding three months, as may be specified in such pass:
Provided that the Registrar may upon application by the ship owner or the authorised agent, grant extension beyond three months for a further period not exceeding three months at a time.
- The other appropriate circumstances referred to in sub-rule (1), in which a temporary pass may be granted, includes the following––
- delayin completion of survey, tonnage measurement, or any other statutory certification required prior to the issue of the certificate of registration;
- the requirement to reposition the vessel for the purposes of fitting-out, sea trials, class surveys, or compliance with statutory requirements;
- delay arising from administrative or technical reasons relating to documentation or processing; or
- anyemergency or force majeure situation, including circumstances involving the safety of life at sea, safety of the vessel, or port operational requirements.
- Avessel issued a temporary pass under this rule shall not be used for any commercial, trading, or carriage of cargo or passengers, or for rendering any other maritime services, during the period of validity of such pass:
Provided that the vessel making an application or holding a temporary pass issued under sub-rule (1), shall continue to possess a valid compulsory insurance or other financial security in accordance with applicable rules made under the Act.
- Temporaryregistration of vessels sought to be – (1) Any vessel not registered under these rules, but sought to be recycled in India in accordance with the Recycling of Ships Act, 2019 (49 of 2019) and the rules and regulations made thereunder, may be temporarily registered under these rules by making an application in Form 12.
- Theship owner, as defined in clause (l) of sub-section (1) of section 2 of the Recycling of Ships Act, 2019 (49 of 2019), or the authorised agent, applying for temporary registration of a vessel for the purpose of recycling, shall furnish proof of ownership of the vessel, and for the purposes of such temporary registration, the ownership criteria specified under sub-section (1) of section 15 of the Act and other registration requirements under these rules shall not apply:
Provided that the temporary registration granted under this rule shall not be construed as registration of the vessel as an Indian vessel under the Act.
- The ship owner referred to in sub-rule (2) or the authorised agent shall for the purposes of temporary registration of vessels to be recycled, provide the following documents as applicable, namely:–
- any documentary proof of the intended transfer of the vessel for recycling or a binding contractual commitment to that effect, which may include a Memorandum of Agreement forsale, a cash buyer agreement, a recycling contract, a commercial invoice, a Bill of Sale, a certificate of possession, or a declaration from the recycling facility confirming its intention to receive and recycle the vessel, as may be available at the stage of application, together with the certificate of registry of the vessel issued in the name of the registered owner:
Provided that where ownership has been transferred prior to such application, the applicant shall also furnish a duly executed Bill of Sale passing title to the registered owner and a protocol of delivery and acceptance as proof of transfer of risk and possession;
- a certified copy of the certificate of registry issued by the Flag State Administration, certifying that the vessel is free from any registered mortgage, subsisting encumbrance, or maritime lien, and such certificate shall not be older than seven days from the date of submission of the application:
Provided that where the vessel continues to be under foreign ownership at the time of application, the foreign owner or the authorised agent shall furnish––
- anirrevocable undertaking for recycling in India;
- an authorisation in favour of the Indian recycling yard or the agent authorised on its behalf , authorising the holder thereof to act on behalf of the foreign owner for all purposes connected with the recycling of the vessel in India, including the execution of all statutory declarations, the making of emergency response and environmental compliance declarations, the satisfaction of all conditions imposed by the Registrar, and the acceptance of service of legal process in India on behalf of the foreign owner, and such authorisation shall expressly require the foreign owner to submit to the jurisdiction of the courts and tribunals of India for all matters arising from or connected with the temporary registration and recycling of the vessel.
- The Registrar may grant temporary registration for the purpose of recycling, subject to the following conditions, namely:––
- the vessel shall possess a valid International ready for recycling certificate or Indian ready for recycling certificate provided under Form 2 of the Recycling of Ships Regulations, 2026 and the International certificate on inventory of hazardous materials issued by a recognised organisation or by the competent authority of the Flag State Administration, in accordance with the provisions of the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, 2009;
- theapplicant shall furnish proof of a valid certificate of authorisation for ship recycling facility issued under Form 3 of the Recycling of Ships Regulations, 2026, by the competent authority, where the vessel is intended to be recycled;
- the ship owner or the authorised agent, shall submit a declaration that the vessel shall notbe used for any commercial, trading, or carriage of cargo or passengers, or for rendering any other maritime services during the period of temporary registration, and that the sole purpose of such registration is to facilitate its lawful recycling within India;
- the applicant shall provide a deletion certificate or equivalent documentary proof from theprevious registry, or a written undertaking to produce such certificate within thirty days from the date of application;
- the ship owner or the authorised agent shall possess compulsory insurance or other financial security in accordance with the applicable rules made under the Act; and
- theship owner or the authorised agent shall submit information about the identity of the registered owner, the beneficial owner, the cash buyer, if any, and every person in the chain of transfer through which the vessel is proposed to be transferred for recycling, together with supporting documents establishing such identity.
- The temporary certificate of registration for recycling shall be granted in Form 13, clearly specifyingthat the registration is valid solely for the purpose of vessel recycling and the ship owner shall initiate the closure upon the completion of the recycling process or on expiry of the validity period, whichever occurs earlier.
- Avessel granted temporary registration for the purpose of recycling shall, from the date of such registration until its final delivery to the authorised ship recycling facility, comply with the provisions of the Recycling of Ships Act, 2019 (49 of 2019) and the rules and regulations made
- No vessel registered temporarily under this rule shall be eligible for conversion to any other
- A vessel holding temporary registration under this rule, shall upon arrival in India, proceed directly and without delay to the authorised ship recycling facility in India.
- No vessel registered temporarily under this rule shall be eligible for conversion to any other
- Validityof the certificate of – (1) The certificate of registration shall remain valid for as long as the vessel continues to be entitled to registration as an Indian vessel under the provisions of the Act and the rules made thereunder, and shall not be subject to any fixed term or period of validity.
- Theprovisional certificate of registration shall remain valid for a period of six months from the date of its issue, unless it is earlier closed or replaced by the certificate of registration:
Provided that the Registrar may upon application by the ship owner or the authorised agent, grant extension beyond six months for a further period not exceeding three months at a time.
- Thevalidity of certificate of registration for foreign vessels chartered by an Indian charterer on a bareboat charter-cum-demise shall be co-terminus with the duration of the charter period, subject to a maximum of five years including any extensions granted.
- The validity of temporary certificate of registration of vessels sought to be recycled shall not exceedthree months from the date of issue of such certificate of registration or upon commencement of the recycling process, whichever is earlier:
Provided that the ship owner as referred to in sub-rule (2) of rule 20 or the authorised agent shall, upon commencement of the recycling process, inform the Registrar accordingly:
Provided further that the Registrar may upon application by the ship owner or the authorised agent, grant extension beyond three months for a further period not exceeding three months at a time.
- Loss,defacement or mutilation of – (1) Where a certificate issued under these rules is lost, destroyed, stolen, mutilated, defaced, or rendered illegible, the owner or operator of the vessel shall, without delay, report the same in writing to the Registrar indicating the circumstances including the location and the approximate date of occurrence.
- Where the certificate is lost or destroyed or stolen, the ship owner or operator shall lodge a complaint or loss report with the nearest police station and shall submit a copy thereof to the
- Any report furnished under sub-rules (1) or (2), shall, inter alia, clearly state the name and particulars of the vessel, the type, name and number of the lost certificate, and the circumstances including approximate date and place.
- Where the owner or the authorised agent of the concerned vesselfails to submit a report under sub-rules (1) or (2), such owner or agent shall be liable for any misuse, fraudulent representation or improper use of the lost certificate.
- Where the certificate is defaced, mutilated or rendered illegible, the original certificate shall be surrendered to the Registrar.
- Uponcompliance with sub-rules (1) or (2), as the case may be, the owner or operator may apply for issuance of a duplicate certificate, along with the fee as specified in the Schedule, and such application shall be accompanied by––
- acopy of the report as referred to in sub-rules (1) and (2); and
- an undertaking declaring that if the original certificate is subsequently traced or recovered, the same shall be surrendered to the Registrar immediately.
- Upon receipt of application made under sub-rule (6), the Registrar shall issue a duplicate certificate which shall have the same legal effect and validity as the original certificate, and shall bear an endorsement stating “Duplicate – Issued in lieu of original lost”:
- an undertaking declaring that if the original certificate is subsequently traced or recovered, the same shall be surrendered to the Registrar immediately.
Provided that if the original certificate is retrieved subsequent to the issuance of the “Duplicate
– Issued in lieu of original lost”, the owner or operator shall surrender such original certificate before the Registrar, without undue delay.
- Theprovisions of this rule shall not apply to certificates issued in electronic
- Changeof name of – Where a company in whose name a vessel has been registered under these rules has changed its name subsequent to registration, the Registrar shall, on production of the certificate of incorporation relating to the new name, make a note of the change of name in the register book in respect of each vessel owned by the company:
Provided that the owner or the authorised agent shall submit an application to the Registrar for change of name within one month of such change.
- Change of address of owner. – The owner or the authorised agent shall inform the Registrar andthe mortgagee, if any, about the change of registered address within one month of such change and make an application to record the same in the register book:
Provided that the owner or the authorised agent shall obtain a no objection letter from the mortgagee, if any.
- Change of name of vessel. –(1) Any change in the name of a vessel already on the register book by an owner, either existing or new, or its authorised agent, shall, upon application made to the Registrar, not be recorded unless––
- the proposed change has been published in two daily newspapers, one being a national daily newspaper in English language and the other in the vernacular language of the port of registry where the vessel is registered; and
- no objection to the proposed change has been received by the Registrar from any person within seven days from such publication.
- The Registrar shall approve the application made under sub-rule (1) and issue a carving and marking note in Form 6 and the owner or the authorised agent shall cause the vessel to be marked
with the new name in accordance with sub-rule (2) of rule 9 and shall return the carving and marking note to the Registrar, duly certified by a surveyor.
- On receipt of the carving and marking note duly certified under sub-rule (3) of rule 9, the Registrar shall record the new name in the register book against the existing official number of the vessel, and endorse or reissue the certificate of registration accordingly.
Chapter – III
Alterations and Transfer of Registration
- Registration of alteration. – (1) Every application for registration of alteration of an Indian vessel shall be made to the Registrar at the first port in India at which the vessel arrives after the alteration or within one month of the alteration, whichever is earlier.
- Wherethe vessel so altered is outside an Indian port, the Registrar may, on report of inspection of such vessel by a surveyor or a person or body of persons authorised under section 9 of the Act, re-register the vessel without any requirement of the vessel to visit an Indian port.
- Whereany application for alteration is not submitted to the Registrar within the period specified in sub-rule (1), the owner shall be liable to penalty under rule 43.
- If the alterations consist of a change in the dimensions of the engine room or other closed-in spaces,or an addition to or removal of a poop deck house, an increase or decrease in the crew spaces or an alteration from motor screw to other propulsion means or vice-versa, the Registrar shall record the alterations in the register book and also in the certificate of registration of the vessel.
- Re-registration due to substantial or major alteration. – (1) Where the alterations are substantialor major, upon application made by the owner or the authorised agent, the Registrar shall carry out a fresh survey and call for a fresh declaration of ownership and proceed to re-register the
- If the alterations consist of a change in the dimensions of the engine room or other closed-in spaces,or an addition to or removal of a poop deck house, an increase or decrease in the crew spaces or an alteration from motor screw to other propulsion means or vice-versa, the Registrar shall record the alterations in the register book and also in the certificate of registration of the vessel.
Explanation.–– For the purposes of this sub-rule, the terms––
- “substantial” means any modification to the vessel’s hull, enclosed spaces, or propulsion system that varies the principal dimensions or tonnage;
- “major”means any change in vessel type or extensive structural
- Wherethe vessel so altered is outside an Indian port, the Registrar may, on report of inspection of such vessel by a surveyor or a person or body of persons authorised under section 9 of the Act, re-register the vessel without any requirement of the vessel to visit an Indian port.
- Wherea vessel is re-registered, the Registrar shall cancel the original certificate of registration, close the existing entries relating to the vessel in the register book, and make new entries in the register book, carrying forward encumbrances affecting the vessel and the new registration shall include references to its earlier registry entries.
- Upon re-registration of the vessel, the original official number, call sign, MMSI number and other identification allotted to the vessel shall be retained.
- Transferof port of – (1) The owner or the authorised agent may apply to the Registrar of the existing port of registry to transfer the vessel to a new port of registry along with no objection letter from the mortgagees, if any.
(2) The Registrar of the existing port of registry shall forward the application made under sub-rule
(1) to the Director-General for approval of such transfer.
- Upon receipt of approval of the Director-General, the Registrar of the existing port of registry shall forward the transcript of registry in Form 2 to the Registrar of the new port of registry.
- Uponreceipt of such transcript, the Registrar of the new port of registry shall issue a new carving and marking note, reflecting the new port of registry which shall be certified by an surveyor.
- When the duly certified carving and marking note is received, the Registrar of the new port of registry shall enter the particulars furnished to him in the register book and issue a new certificate of registration.
- Upon receipt of the new certificate of registration, the owner or the authorised agent shall surrender the old certificate of registration to the Registrar of the previous registry.
- When the duly certified carving and marking note is received, the Registrar of the new port of registry shall enter the particulars furnished to him in the register book and issue a new certificate of registration.
- Recording and publication of inactive vessel. – (1) The Registrar may, after due verification andserving at least three notices to the registered ship owner at intervals of not less than thirty days each, record the status of such vessel as inactive in the register book maintained at the port of registry, if the vessel––
- hasnot undergone the periodic inspection or survey as per applicable rules made under the Act;
- hasremained non-operational for a continuous period of thirty-six months;
- has not been engaged in any commercial, training, or auxiliary service during the period specified in clause (b):
Provided that a vessel which is under lay-up notation of a recognised organisation and complying with the applicable rules made under the Act, shall not be treated as inactive.
- TheRegistrar shall make an entry in the register book indicating the date from which the vessel is declared inactive, along with the reasons and references to the notices served, and the certificate of registration of such vessel shall be endorsed accordingly and publish the details of such vessel on the official website:
Provided that the entries relating to ownership, mortgage, and registration particulars shall continue to remain valid in the register book during the period of inactivity.
- A vessel recorded as inactive in the register book shall not be entitled to proceed to sea and engage in any commercial activity until the vessel is restored to active status.
- Restorationto active status of inactive vessel.–– (1) The ship owner of an inactive vessel may apply for restoration to an active status on submission of satisfactory evidence of seaworthiness, operational readiness and upon restoration of the compliance with the Act and applicable rules made
(2) The Registrar shall, on verification of compliance under sub-rule (1), record the vessel as active in the register book, endorse the certificate of registration accordingly and update the information on the website.
- Deletion of inactive vessel. – (1) Where an inactive vessel has been found to be scrapped, dismantled,destroyed, sunk, or transferred to a foreign flag, the Registrar shall, after due verification and ensuring that no mortgages exist, record the grounds for deletion in the register book and issue the certificate of closure of registration in Form 17 and a deletion certificate in Form 18.
- The Registrar shall publish such deletion on the official website and in two daily newspapers, one being a national daily newspaper in English language and the other in the vernacular language of the place where the vessel is registered.
- Where the vessel is deleted from the register book, it shall cease to be an Indian vessel, and all rights, privileges, and liabilities shall be terminated.
- A vessel deleted from the register book due to scrapping, destruction, or total loss shall not be eligible for re-registration.
Chapter – IV
Transmission, Transfer, and Judicial Sale of Vessels
- Transmissionof property in Indian vessel on death, insolvency, – (1) Where the property in an Indian vessel or any share therein is transmitted to a person on the death, insolvency or by any lawful means other than a transfer under the Act, that person shall provide a signed declaration of transmission containing therein the identification of the vessel, the manner of transmission and the person entitled thereto and––
- ifconsequent on insolvency, such declaration shall be accompanied by proof of claim; and
- ifconsequent on death, such declaration shall be accompanied, in original or a certified copy, by a succession certificate or probate or letters of administration or any such document in accordance with the applicable law for the time being in force.
- Upon receipt of the declaration of transmission, a fresh declaration of ownership shall be
- Uponthe fresh declaration of ownership, the Registrar shall enter in the register book the name of the person entitled under such transmission as the ship owner of the vessel or share therein and issue a new certificate of registration:
- ifconsequent on death, such declaration shall be accompanied, in original or a certified copy, by a succession certificate or probate or letters of administration or any such document in accordance with the applicable law for the time being in force.
Provided that no such entry shall be made if, as a result of the transmission, the vessel ceases to be an Indian vessel.
- Orderfor sale where vessel has ceased to be Indian – (1) Where, due to transmission of property in a vessel or share therein on death, insolvency, or otherwise, the vessel ceases to be an Indian vessel, the Registrar of its port of registry shall, within fifteen days of obtaining knowledge of such transmission, submit a report thereof to the Director-General and shall issue a notice for sale of the vessel to the person entitled for such transmission.
- Theperson entitled may, within a period of six months from the date of the notice issued under sub-rule (1), transfer the vessel or share therein to a person eligible to be the owner of an Indian vessel under sub-section (1) of section 15 of the Act:
Provided that the Director-General may, upon application made by the person entitled under the transmission, grant an extension beyond six months for a further period not exceeding six months, for reasons to be recorded in writing, and subject to such other terms and conditions, if any, as may be specified in the order.
- Whereno transfer is registered within the period specified in sub-rule (2), the Director-General may, after giving the person entitled, an opportunity of being heard, direct the Registrar or any person authorised by the Director-General, to proceed with the sale of the vessel or share therein to any person eligible to be the owner of an Indian vessel.
- Upon receipt of the direction under sub-rule (3), the Registrar or any person authorised by the Director-General, shall––
- servenotice of not less than thirty days of the intended sale to the person entitled, every registered mortgagee and every other person appearing in the register book to have an interest in the vessel or share;
- obtain a valuation of the vessel or share from a surveyor or a valuer approved by the Director-General and fix a reserve price on the basis of such valuation;
- conduct the sale by public auction, including electronic auction, after publication of the noticeof sale on the official website and in two daily newspapers, one being a national daily newspaper in English language and the other in the vernacular language of the port of registry where the vessel is registered; and
- completethe sale within a period of six months from the date of such direction:
Provided that the Director-General may grant further extension for a period not exceeding three months, for reasons to be recorded.
- Nosale shall be concluded at a price below the reserve price fixed under clause (b) of sub-rule
- andno sale shall take effect unless confirmed by the Director-
- Notwithstanding anything contained in sub-rule (5), in the event that three attempts of sale by publicauction fail, the Registrar or any person authorised by the Director-General shall conduct the sale of the vessel by public auction to the highest bidder with the prior approval of the Director-General, in any of the following circumstances, namely:––
(a) if the vessel is in a deteriorated condition and that there is every probability or likelihood that the vessel poses threat or danger to human life, navigation or marine environment;
- the vesselor the crew is in an abandoned state and maintenance becomes practically impossible due to weather conditions or for any other reason; and
(c) such other circumstances or reason, as the Director-General may by order specify in this behalf.
- The sale of a vessel or share therein shall be subject to any mortgage or mortgages recorded in theregister book, unless such mortgage is satisfied out of the proceeds of the sale and discharged in accordance with sub-section (4) of section 26 of the Act.
- Theproceeds of the sale shall be applied in the following order of priority, namely:––
- any wages and other amounts due to seafarers in connection with their employment on the vessel;
- the costs and expenses of the sale, including the expenses of valuation, publication and conduct of the auction;
- any unpaid fees, dues orpenalties payable in respect of the vessel under the Act and the rules made thereunder;
- theamounts due under the registered mortgages, in the order of priority under sub-section
- ofsection 26 of the Act;
(e) the balance amount, which shall be paid to the person entitled:
Provided that where the person entitled to the balance amount cannot be traced or does not claim the same, such balance shall be held in deposit by the Registrar for a period of three years and shall thereafter be dealt with in accordance with the directions of the Director-General.
- Uponconformation of the sale, the Registrar shall, –
- enter the name of the purchaser in the register book as the owner of the vessel of share therein;
- issuea fresh certificate of registration in accordance with these rules; and
- record in the register book the particulars of the notices served, the valuation obtained, the conduct and confirmation of the sale and the application of the proceeds.
- Transferof a vessel or share on sale by order of –– Where any court or tribunal orders the sale of a vessel or share therein, the Registrar shall comply with such order and carry out the registration formalities as per these rules.
Chapter – V
Mortgage of Vessels, Closure and Extension of Registration
- Mortgageof – (1) The instrument of mortgage of a vessel, provisionally or permanently registered under these rules, other than a vessel registered for the purpose of recycling or a vessel operating under a temporary pass, shall be in Form 14 or Form 15, as applicable, and such forms may be submitted in electronic mode to the Registrar of the port of registry, who shall, upon receipt thereof and subject to compliance with section 26 of the Act and these rules, record the mortgage in the register book.
- When there are several mortgages on the same vessel recorded in the register book, their respective priorities shall be indicated in the appropriate column by capital letters A, B, C, etc, in alphabetical order.
- For registration of any mortgage, a no objection letter from every existing mortgagee, if any, shall be required.
- Every registered mortgagee of a vessel who intends to recover the amount due under the mortgage by selling the mortgaged vessel or share under sub-section (1) of section 27 of the Act, shallgive an advance notice of fifteen days relating to such sale to the Registrar of the port of registry of the Indian vessel in Form 19.
- Aregistered mortgage of a vessel or share may be transferred to any person or joint owners or a company in Form 14 or Form 15 and such transfer shall be recorded by the Registrar in the register
- With respect to registration of a foreign vessel chartered on a bareboat charter-cum-demise contract by an Indian charterer, the rights of mortgagee and ownership title of such vessel shall be governed exclusively by the laws of the primary registry.
- Upon the judicial sale of a registered vessel pursuant to an order of a court or tribunal, the following shall be applicable, namely:––
- where an order of the court or tribunal is made for the sale of a registered vessel, any mortgage or charge registered against the vessel shall be extinguished upon completion of the judicial sale, and the vessel shall vest in the purchaser free from all encumbrances, liens, attachments, registered mortgages, and other charges of whatsoever nature unless otherwise directed by the court or tribunal;
- theRegistrar, upon receipt of the order of judicial sale, shall delete from the register book all mortgages, hypothecations, and registered charges attached to the vessel prior to the sale, and shall register the vessel in the name of the purchaser or issue the certificate of closure of registration in Form 17, deletion certificate in Form 18, and the purchaser of the vessel through judicial sale shall acquire the vessel with a clean title, free from all prior mortgages, liens, and encumbrances, except those assumed by the purchaser with the consent of the holders unless otherwise directed by the court or tribunal.
- Where a registered mortgage is discharged, the Registrar shall, upon receipt of the instrument relating to the discharge of the mortgage under Form 14 or Form 15, duly endorsed by the mortgagee, make an entry in the register book recording that the mortgage has been discharged.
- Transmissionof interest of mortgagee in vessel or share on death, or – (1) Where the interest of a mortgagee in a vessel or share is transmitted by death, insolvency, or any lawful means other than a transfer under the Act, such transmission shall be authenticated by a declaration made by the person to whom the interest has been transmitted, stating the manner of transmission, and accompanied by documentary proof of the corresponding transmission of interest of the mortgagee in Form 16.
(2) Upon receipt of the declaration and documentary proof referred to in sub-rule (1), the Registrar shall amend the name of the person in the register book as mortgagee of the vessel or share.
- Closure of registration.–– (1) The ship owner or authorised agent of a vessel shall apply for closure of registration within thirty days of such vessel ceasing to be an Indian vessel.
- Upon application by theship owner or his authorised agent, the registration of a vessel shall be closed under section 43 of the Act––
(a) for vessels referred to in sub-section (7) of section 20 of the Act; or
(b) on sale of the vessel to a foreign owner:
Provided that where the vessel is sold to a foreign owner and deleted from the register book, the vessel may be re-registered upon re-importation and fulfilment of all applicable requirements under these rules and the provisions of the Act.
- The Registrar shall complete the closure within ninety days from the date of application and issue the certificate of closure of registration in Form 17 and deletion certificate in Form 18.
- Upon occurrence of any of the following events, the charterer or authorised agent shall inform the Registrar within thirty days from the date of such occurrence, namely: –
- the expiryof the period of registration as specified in the certificate of registration and entered in the register book, where no extension has been recorded under rule 38;
- thetermination or expiry of the bareboat charter-cum-demise agreement;
- where the registered charterer ceases to be the charterer of the vessel or ceases to beeligible to own a vessel under sub-section (1) of section 15 of the Act;
- wherethe vessel is re-registered or resumes the right to fly the flag of, the primary registry; or
(e) where the vessel is destroyed, or is actually or constructively lost, including by demolition, fire, sinking or wreck.
- Upon receipt of information or occurrence of any of the events specified in sub-rule (4), the Registrar shall close the registration of a vessel registered under bareboat charter-cum-demise contract, by recording such closure in the register book and require the surrender of the certificate of registration of bareboat charter-cum-demise.
- In case of closure of temporary registration of vessels for recycling, as provided under these rules, the Registrar shall record in the register book, the particulars of such vessels, including the dateof arrival, name of the recycling facility, and date of cancellation of the temporary registration:
Provided that upon completion of the recycling process, the ship owner or the authorised agent or the recycling facility shall furnish to the Registrar a statement of completion of ship recycling in accordance with the regulations made under the Recycling of Ships Act, 2019, (49 of 2019) and the Registrar shall record the same in the register book and close the entry accordingly.
- Extensionof bareboat charter-cum-demise – (1) Where a bareboat charter-cum-demise contract is extended by the Indian charterer, the charterer or the authorised agent before the expiry of the existing period of registration shall make an application to the Registrar in Form 5, for extension of the registration and such application shall be accompanied by documentary proof, to the satisfaction of the Registrar, showing, ––
- theextension of the bareboat charter-cum-demise; and
- the continued closure, suspension, or non-operation of the registry of the vessel in the country of its original registration for the period of the proposed extension.
- The Registrar, if satisfied with such documentary proof, may record the extension of the registration in the certificate of registration and the register book.
- The period of extension shall not exceed the duration of the renewed or extended charter-party and shall be subject to compliance with all conditions specified under these rules.
- Transfer of bareboat charter-cum-demise vessel to Indian registry. – (1) The charterer of a foreign vessel which has been registered as a bareboat charter-cum-demise under these rules shall submitthe following documents within thirty days from the date of completion of the charter period, for the purpose of registration of the vessel, namely:––
- the instrument of sale or sale deed as documentary proof of the transfer of ownership to any eligible person under the Act; and
- adeclaration of
(2) Upon satisfaction of the requirements specified in sub-rule (1), and verification of the documents, the Registrar shall issue a certificate of registration to the vessel.
Chapter – VI
Fees, Penalties and Miscellaneous
- Returnsand – On or before 15th January of each year, every Registrar shall submit to the Director-General, a return showing the number of vessels with their tonnages registered in the register book during the previous year.
- Noticeof trust not – No notice of any trust, express, implied or constructive, shall be entered in the register book or be receivable by the Registrar, and subject to any rights and powers appearing in the register book to be vested in any other person, the registered owner of vessel or of a share therein shall have power to dispose of the vessel or share in the manner provided in the Act and to give effectual receipts for any money paid or advanced by way of consideration.
- – The fees shall be levied under these rules at the rates and for the purposes as specified in the Schedule.
- – (1) A person who contravenes any provision of these rules, shall be liable to a penalty in accordance with sub-section (2) of section 320 of the Act.
- – The fees shall be levied under these rules at the rates and for the purposes as specified in the Schedule.
- The penalty so imposed shall be payable to the Registrar of the Mercantile Marine Department or the Director-General, as the case may be.
- Any change in completion particulars or any information required to be reported under these rules, if not communicated within a period of thirty days from the actual date of such change or completion, shall be treated as a contravention of these rules and shall be liable to penalty in accordance with the Act.

INSTRUCTIONS REGARDING CARVING AND MARKING NOTE
in accordance with Rule 9(2) of the Merchant Shipping (Registration of Vessels) Rules, 2026
The carving and Marking of the Vessel shall take place as follows:
- Thename of the vessel and the port of registry shall be painted on the port and starboard bows and on the stern.
- Themarkings shall be made in Hindi and English, with the Hindi inscription placed above the English inscription, and the letters shall be painted on a dark background in white or yellow colour, or on a light background in black colour, The minimum height of the letters shall be 10 centimetres and the minimum width shall be 1.3 centimetres.
- Where, due to structural constraints, sufficient space is not available on the stern for paintingthe name and port of registry, the same may be painted on both quarters of the
- Officialnumber and the number denoting the registered tonnage shall be engraved on a brass plate 30 cm x 6 cm wide, and the same shall be affixed in a conspicuous place on the navigation bridge of the vessel.
- The scale of draught marks shall be cut off or welded in metres and decimetres both forward and aft on the port and starboard side respectively.
- Incase of vessels having a raked soft stem and cruiser stern, the marks shall be cut in or welded as close and aft of the stem as possible, following the contour of the stem, and the marks aft, or at the stern, shall be cut not more than 2 metres forward of the after
In addition to the requirements as stated above, markings of the IMO ship identification number shall be made permanently in a manner that it is plainly visible and distinct, free from obstruction or interference by any other markings, and shall be painted in a contrasting colour; the height of such markings shall not be less than 200 millimetres on the exterior of the vessel and 100 millimetres in internal locations and the marking shall be made by raised lettering, cutting, centre-punching, or an equivalent permanent method in accordance with SOLAS regulation XI-1/3, as amended from time to time.
